WE WERE UNABLE TO CLAIM THE STIMULUS CHECK LAST YEAR BECAUSE WE FILED FOR ITIN.

WE WERE TOLD THAT WE COULD GET IT THIS YEAR. WE BOTH ARE HERE NOW HAVE SSN{BOTH} NOW THE TAX PREPARER SAID WE CANNOT GET IT?

Do you mean a tax refund or a stimulus check? I don't think there will be any stimulus checks for anyone this year, all that money they are talking about is going to businesses to safe them from bankruptcy and/or create jobs (and that only if you believe the politicians...).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes, you can get the stimulus. Once you both have your SSN's, it is computed on your 1040. You do not receive a separate check, you receive it with your refund. Your refund is actually the Rebate Credit + your normal refund. If you want the IRS to calculate the amount, put the letters RRC next to line 70 on your tax return (1040). If you use another form look for the line that says Recovery Rebate Credit and put RRC there. It also tells you what page is the worksheet to figure it out.

I just reread your post. Just collect your tax return and if there is no number for Rebate Credit, Write RRC on that line for the Rebate Credit. The line is 70 for the form 1040. It is in the section for payments on the forms.

Same thing happened to us. I just completed our joint tax return for 2008 and the tax preparation software specifically asked that question. Once I answered "no," it deducted $1,200 from our tax liability. I was told by the IRS last year that this question would be on the 2008 1040 forms, and it is. Your tax preparer must be misinformed. It was called a Tax Rebate, not a stimulus check.

Try TaxAct online filing. There is a part of the 2008 return allowing you to collect unpaid stimulus from last year. At the time I was "single" and received $600. At time of filing I was "married" for less than 6 months of the year and was allowed to claim an additional $300 when I filed the return for 2008. The online program will take you through the worksheet and calculate for you, then file your (federal) tax for FREE. It is an excellent system.

the 1200 will be treated as if u have with-held/paid estimates during the yr.

last yr they estimated the stimulus $ based on ur 2007 return. now they will look at acutal 2008 and see if u shuld've rec'vd more.

now remember u must have paid 1,200 or more of taxes to get it back...
