Sorry folks, I just have to vent a bit !!!

Wife went to Bogota embassy for interview yesterday. All documents needed, photos, original documents, and photocopies for them to keep. I sent, I-864, pay-stubs, W-2, 1099's, past taxes, and clearly showed I had enough income to support my wife. Visa denied because they wanted a co-sponsor also. Are you kidding me ? I already made way over what the requirement for two people was. So they send my wife away, keeping all original documents and photo copies. Gave her a form in Spanish saying I need an original I-864 and an I-864A. Well I have two children now at NVC in the process, that needed those original documents. They gave her a phone number to call and so I called today. They want me to charge my CC for $16 just so I can find out what the fok they want ? They can't be serious ? So now I am really screwed. About two more months of this and I will sneek them across the Mexican or Canadian border. Hell, everybody else is doing it ! I have just had it with the whole system.

I'm so sorry to hear about this elkfarmer but if you make more than 125% over the poverty line then you should be fine. Maybe you can print this out and show it to them: I-864P. It shows the Poverty Guidelines in order to have a visa granted. You should also visit the 2009 Federal Poverty Guidelines and make sure your salary is 125% over.

They shouldn't deny the visa if you make more than enough.

Sorry to hear about your situation. Did they issue a denial of Visa or did they just send your wife away with an ask to return with the appropriate forms??

Would the income declared on your I-864 continue from the same source after you move back to the US? If not, they were justified in requiring a joint sponsor. However, the I-864a us for a household member. Any joint sponsor is probably not in your same household, so they would need to provide an I-864, not I-864a. If those circumstances match, the children will each need joint sponsors as well.

Facts are cheap...knowing how to use them is precious...

Thanks for the reply Luv. I am semi-retired and the total I made for last year was 22 Mil. I only had to make, $17.5. I think the new is 18 something but those figures would not apply yet. but it is a little late now. Visa denied until I get a co-sponsor. I doubt, if I had been there it would have helped, but who knows. But then, probably a real good idea I WAS NOT THERE !!!!!! THEM JAR HEADS AND I PROBABLY WOULD HAVE HAD WORDS. I have a low flash point when I clearly know I am right.

Okay, let me clarify things a bit. I am a USC living in USA. I made 22 thousand last year. I had to make $26,500 for 4. I sponsored my wife only. The I-864 stated that. I only had to make 17.5 for two of us. It was my wife's interview only. My children will get interviews later and at that time, I would have needed a co- sponsor. Or my job will start back for the summer,( In April) and I will make more money then Social Security allows. I will have to pay back Social Security $1 for every two I make over $14,000 in earnings. I will make over 16,000 in 7 months.

So now maybe you can see my frustration. My wife was not denied. She was just told I needed a co-sponsor for her, to even be approved. Once I do that, she can return. When they have time to see her again.

Well, that makes more sense now because if the embassy was aware of the children, even if they have their interviews at a later time. So as a whole you had to include everybody you will be responsible for and that's why you will need a co-sponsor. They're pretty strict about that, so they say "ok you made this much last year (based on your taxes), you will make this much this year (based on letter of employment and copies of pay stubs) and you will be responsible for these many people". If according to the I-864P, which should be updated to reflect 2009 figures, you do not make enough they will automatically ask you for a co-sponsor.

But like you said, she wasn't denied, her approval was just delayed until she goes back to show the co-sponsor info. No big deal.

WOW sorry to hear of your trouble, as Diana states though they know the kids are coming and the CO wants to make sure that all parties are covered most likely, even though it was only her interview I am sure this may have an impact, get that co sponsor now for the the lovelies in your life and it will be one less headache when the kids do have the interview also. Try sending them an email they were pretty good about answering mine when the step kids went through. Just remember the kids also have to go, so glad you were not there to blow a gasket. I wish you the best of luck, you may now be a little delayed for the NVC for the kids which stinks but now would be the time to get addtional certified and original copies of all docs. I had at least 4 copies ( original and certified copies ) of everything since I had the 2 kids going through also.

AS far as the kids, my income is way above the suppoert needed for dad , 2 kids and my child. All they did was keep copies of the last 3 years, husband had to go out of the emabassy to get the copies as I only sent 1 copy of 2004 and 2005.

If you have children, even if they do not live with you, they will be included in your family size for the minimum salary required as a sponsor. So in reality, you have to have enough to support four people, not two, even if your children do not live with you and you do not provide 100% support for them.
