thanks again for everyone's help

I have one final decision that is haunting my brain

To use the VWP or risk the tourist Visa.

my thinking is that is is less likely they will let me stay the full 90 days on a Visitors Visa, compared to the VWP which is unextendable.

or if I have a ton of evidence that I intend to return to Australia in 90 days, are my chances exactly the same on either the vwp or the tourist visa?

I really don't want to mess this up.

I would be a million times more confident with confirmation from someone that it is ok to submit the forms while I am there with my girlfriend.

at least then if I am admitted through customs for 3 months... we have 3 months of processing time to spend with each other before I have to return home for the rest of the wait and for my interview.

You wouldn't have 3 months of "processing time" together unless the petition were already filed before you arrived. Three months, perhaps but not three months of processing time. I think it's impossible to tell you whether a visa or VWP provides a better chance of entry for you because we don't know the totality of the circumstances. Included in those would the questions and answers at the POE when you attempt to enter.

You should probably be thinking in terms of, "I can probably visit once or twice during the visa process but we are likely to face months of separation, like every other K1 couple faces."

I think I'm just going to do the VWP and I'll try and fly back again on it when the 3 months is up.. I know the chances aren't likely the second time, but I'll try anything.
