Dear USCIS examiner:

We applied for I-751 (Application to remove conditional residential status) for Niti Arora last year in November 2008. We received the “Notice of Action” letter indicating the receipt number as “EAC-xx-xxx-xxxxx” in last week of November, 2008. Since then, we have been waiting to receive the biometric letter for finger printing for Niti Arora. We have not received the biometric letter yet.

Upon inquiring about biometrics appointment over the phone, we received a letter last week stating that “Electronic records show that you attended your scheduled biometrics appointment on October 28, 2008. Since you have attended your appointment there would be no purpose to re-mail your biometrics notice.” Since we have applied for the I-751 petition on November 7th, 2008, Biometrics appointment on October 28, 2008, appears to be disconnected. We have neither received any Biometrics appointment letter for October 28 2008 nor she (Niti Arora) has gone for biometrics on that day.

We would really appreciate if you can look into this matter further, so that it won’t give us any other problem in long run.

Please advise me if you have any further questions or problems related to this petition.

Attached are the copies of “Notice of Action” and the letter we have received from USCIS.

I think the best thing would be to make an Infopass appointment and bring copies of the Notice of Action, that way you can take care of it in person.

07/20/11 - Oath ceremony - same day as interview

I agree. Your letter may take a year to get to someone's desk. You would be much more successful with an infopass - in fact, your wife may even be able to do the biometrics while at the Infopass - it has been known to happen.
