How do I deal with the family at tax time since we have been married but

the family is not here yet? Can I file married and can I claim them?

Wnt to be correct. I am sure many of you have ythe same situastion

and I would appreciate the help.

We qualify for "considered unmarried". If that benefits you, cool. It worked out better for me to file HOH(which i can since i meet the qualifications for "unmarried") if not there are some steps to file married filing seperate. someone will come along and tell you all about it im sure :D

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Check out Pub 519 for claiming the spouse as a full time resident as long as you file married jointly. You may want to also do some searches on VJ. There has been more than a few threads on taxes for 2008

We have exactly this situation. One of Alla's boys is here, the other is at a university in Moscow and will not come here until summer on a K-2 visa. We filed "married filing jointly" and claimed the younger boy (who is here) because he has adjusted status and has a green card AND social security number. You MUST have a social security number to claim them. Both Alla and Pasha have this and are permanent residents. Sergey has not yet been here and we cannot claim him even though he is definitely a "dependent" Fortunately, it made ZERO difference for us as we had enough deductions, credits, etc. I had at first calculated the return WITH Sergey, then re-calculated without and our return was exactly the same, but that is only our situation.

K-2 beneficiaries cannot get an SSN until they adjust status, you fiancee can get one immediately upon arrival. If you go to file for a number, you can go back to the SS office the next day and get a printout of her number, the card will be 7-10 days to arrive but they can give you the number the next day.

Correct, you CANNOT claim as a dependant a non-resident alien....

A K-2 ie not eligible to applu for a SSN until they adjust status (greencard) or receive EAD (I-765 application)
