Hi there,

I'm just wondering if time spent in the USA can affect your K1 application in any way? I've had a K1 pending since October and I've just returned to the USA a week after staying 86 days and am probably going to stay for a similar period as my financial situation allows it. Can this affect anything?

As long as you don't stay over 6 mos. you are good, also I think for citizenship after a certain amount of time that counts for the 3-5 year waiting period to become a USC.

Our Timeline:

11/1999 - We met in Ecuador

02/05/00 - Relationship started

09/08/06 - Engaged & Pregnant!

03/13/08 - I filed for Citizenship

07/22/08 - Became US Citizen

08/02/08 - I-129F sent

08/13/08 - Case received by VSC

08/16/08 - NOA1

08/18/08 - Touched

12/18/08 - Touched again exactly 4 mos. after 1st touch!

12/18/08 - Noa2 @ 3PM-Gracias Dios Mio!

12/24/08 - NVC sent pckg. 3 to Embassy

01/02/09 - Pckg 3 rcvd. by Embassy

01/09/09 - Pckg 3 from Embassy received by beneficiary

02/09/09 - Medical exam

02/16/09 - Sent back checklist and docs required by embassy.

03/13/09 - We will fly to see Daddy Gary

03/16/09 - 1 PM Interview (Pray God he gets visa)

03/16/09 - 5PM INTERVIEW PASSED WOOHOO. Thank God.

03/25/09 - Visa on hand! he went to DHL office after phone call received.

04/18/09 - My Cuchi came, (NYC)a wonderful unbelievable moment!:)

04/20/09 - We applied for marriage licence. (Township Municipal Bldg Health Dept.)

04/23/09 - Licence on hand

04/29/09 - Applied for Social Security (He was in system!)

04/30/09 - Wedding day!!! Yeeebaa

05/07/09 - SS card in mail. "valid for work only with DHS authorization"

05/13/09 - Sent AOS paperwork.

06/16/09 - Biometrics Apptmt.

06/25/09 - EAD Card in mail!

06/26/09 - Letter saying case transfered to Cali.

08/08/09 - Residence Card in Mail! Yuuupiiiiiii.

THE END FOR 2 MORE YEARS.

I don´t need patience if I have love. Ah I que Viva mi Guayaquil Carajo!

no, the time clock for citizenship begins only after you become an LPR

Wow! You didn't have any trouble at immigration? I was told by an immigration lawyer that they can see that you have filed the petition know you're engaged which makes them really sketchy about letting you in, especially for more than a week.

Actually, if the OP enters on the VWP there is only a 90 day allowable visit.

  • 13 Jan 2012 - Biometrics appointment
  • 24 Aug 2012 - RFE (bummed!!!)
  • 13 Sep 2012 - **APPROVED!!**
  • 24 Sep 2012 - Card received

I wouldnt be too worried about it and I think that your immigration lawyer is just trying to scare you. I dont know if it is different because I dont need a visa to visit my SO but no one has ever questioned me in great detail about my SO and the K1 process, so I am not sure that they even know about pending K1 visas. As long as you can provide a copy of your itinerary and show that you have ties to your home country you should be fine IMO. I visited my SO for 2.5 weeks over the Christmas holiday and there was no problem at my POE, well the border guard guy did make fun of me for meeting my hunnie on WoW but that was it. I would try and schedule your stay for a lesser amount of time because essentially they want to see that you are spending more time in your home country then theirs.

Nich-Nick contacted Customs and Border Patrol and asked whether POE can see that you have a I-129F pending and was told no. It has been discussed recently in the UK forum and here is her post on the matter http://www.visajourney.com/forums/index.ph...p;#entry1948785

Hmmm okay. I also ask this because when my fiance visited last November they nearly refused him at immigration because he said "girlfriend." Also, Continental doesn't let you print out all your tickets at once so he couldn't prove he had a return ticket.

Sometimes it depends on the officer. Some can be really grouchy but some can be friendly. Last trip I did I said I was seeing my boyfriend and we had a really nice chat on why he was there and I wasn't and what we did for a living.

I guess that's true. When I went through Birmingham the man was really cool and just asked about how it was having such a long distance relationship haha. Heathrow wasn't so friendly :P
