Will a waiver help my case

I need some information about my husbands immigration case.

We didnt get a lawyer or anything. Finally we got and appointment in Ciudad Juarez, Chihuahua for his visa. We went to the appointment and they denied his case for illegally entering the USA 2 times. They told him that he was banned for 10 years. We asked what I would do and they said move to Mexico if i wanted to be with my husband, so i moved there to be with him. My husband has been in Mexico for 4 years in May. The past 3 years and 3 months i have been living in Mexico with my husband and daughter of 1 year 4 months. Is there any advise you can give me or if I can file a petition or a wavier to help him bring back before the 10 years.

They should have told you about filing a waiver at the time of the interview. You will find tons of cases pertaining to Mexico, and the filing of waivers in cases like this at http://www.immigratetous.net.

It sounds like you are saying that he has been banned using INA 212a 9C. . . is that correct? This would mean that he did one of two things:

1. EWI'd stayed for more than a year, exited, then EWI'd again

or

2. EWI'd, was deported, then EWI'd again.

This would mean that he is not eligible for a waiver until he has been outside the U.S. for 10 years.

Is this what happened?

I have the same exact situtation. My husband has been banned using 212a9bII & 212a9cI. He stayed more than a year then exited and came again. His interview was on 2/9/09. Is there anything we can do. Here is my post.

My husband had his interview at the US Embassy in Juarez Mexico and it was denied and said he could not come back 10 yrs. At the interview they asked him who his co-sponsor is, where he lives, what my name is, where I was born, his address, which he answered all correctly. Then they asked him the first time he entered the US and how many times he entered, which he truthfully answered. He entered illegally 10 yrs ago and entered 3 different times then she said she was sorry but his visa was denied and could not come back for 10 yrs. Is there anything else I can do. I've been told I can apply for a work permit. Is this true? Should I talk to a lawyer? Please anyone help with suggestions. I am so upset with my government. I don't see how they can keep a family apart. We did everything by the books, We paid all that money, for what? My husband has never been in any kind of trouble. It was just a big slap in the face. Any suggestions of comments are welcome.

I'm sorry, but a finding of 9c as your ineligibility means no solution until either the law changes, or the applicant has been outside the U.S. for ten years. There is a whole club of people on www.immigrate2us.net who are in this situation. There is no waiver for 9c.
