I came here in the US via K1 together with my kids as K2 in July 2007. We filed AOS as soon as we got here trying to beat the deadline of the new fees, but we didn't made it. USCIS rejected our application twice requiring us to pay the new fees. We don't have enough money to cover all the fees for me and my 4 kids during that time so we decided to dropped the kids application and go ahead of mine. I got my GC just recently and we are now planning to reapply for the kids which obviously will cost us a fortune. I have some concerns before sending the applications since they are already out of status.

1. Do i need to update their medical/vaccination records? Are there any changes?

2. My husband who is the petitioner lost his job last year and has no luck in finding any job at the moment, but i am working and both our income for the last year met the poverty guidelines requirement for 6. My question is, will it be an issue when we fill out the affidavit of support? Or do we need a co-sponsor?

These are only some of the few concerns that i have in mind right now. I am hoping somebody who have the same situation as mine can share any ideas. I would greatly appreciate any response.

GOD BLESS!

With 4 kids I think I'd forget about doing the medicals and take a chance and just send in copies of their DS 3025 vacinnation records.

They may get asked to do the medicals but some people get by without doing so.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

This may cost you a lot of money.

You have to pay the whole fee for AOS (930.00 + biometric depending on the age of the kids).

You have to do a new medical because the old one is done more than one year ago (you might get by as Haole wrote, but don't bet on it)

I would do the I-864 with the 2008 tax return if possible, if not possible you have to use the 2007 tax return and estimate the income for 2008.

You may need to have a co sponsor, if they are asking for actual w-2s.

Wishing you luck.
