Hello, I just posted elsewhere on the site but I am new to this and I am not quite sure whether I am doing it right....

SO, I sent in the AOS paperwork for my husband on November 15th, 2008. Soon after the check was cashed and we received both the AOS and the EAD Notices of Action. My husband had his Biometrics appointment on January 27th and there has never been any update to his case status on the USCIS site. I have noticed that even early December filers have been receiving their EAD approvals and so many people have been scheduled for their AOS interviews. I do not understand why our case would be taking longer. Does nayone have any insight or any ideas? Has anyone gone through a similar situation? I'd really appreciate some help!

In case it matters, he entered on a K-1 visa.

Nothing you can really do about it. I see people that sent applications WAY AFTER i sent mine (like people on the December thread) that already have interview datres. I saw people with EAD approved right the day after the biometrics appointment. And then, here and there, people like you, or me, who get pushed back. Not the fault of people being approved - it does not depend on them.

I guess it depends on the immigration officer administering the application, at the national benefit center or locally, how well they do their job, how quickly they move the files from the unsolved stack to the solved stack, what mood did they woke up with that day, how hot was the cup of coffee or the woman/men they had, what time is the sun coming up and so on. There is not much we can do.

11/17/08 : Application sent (I-130, I-131, I-485, I-765)

11/18/08 : Official receipt of documents stated on I-797C (Signature for receipt at USCIS was on 11/17/2008 at 10PM)

11/28/08 : NOA Received ( I-797C) for all 4 forms (forms issued on 11/26/2008)

12/18/2008: LUD on I-130, I-131, I-765

01/29/2009: Bio done

01/29, 30/2009: LUD on I485 and I765

2/10/2009: issued AP, valid 1 year for multiple entries.

2/23/2009: Got EAD card

3/8/2009: LUD on all applications. Shows approval of I131 and I765, still pending on I130, I485.

04/28/2009 at 9:30 AM: Interview. Told to wait 90 days for a resolution by mail.

05/01/2009: Card production ordered.

05/06/2009: Received approval NOAs for I130 and I485 (welcome notice, 10 years card). I130 still shows case received and pending.

06/18/2009: got the 10 years validity card. Process length: 213 days since sending the applications.

No RFE at all along the process.

EADs are supposed to be approved within 90 days. If you haven't gotten any indication it's been approved ninety days from the notice of action, call them. They don't have a time limit on AOS, just the EAD. My DIL's was filed separately, and it arrived yesterday, rather speedily as far as the USCIS is concerned.
