Hey Guys,

I just received the NOA1 i-797c for the 1-130, and had a couple of questions as i am about to apply for K-3

A little background, i just applied for i-130 and received the NOA1. Is K3 the right way to go? My spouse is pakistani and my service center is California.

In the 1-129f package checklist.

It list "Copy of I-130 Transfer Notice (indicating where your underlying I-130 petition was routed to after it was filed at the appropriate Chicago Lockbox)."

What is this?

Also do i need to submit another fee even though i submitted a fee for i-130?

Thanks for your help

the "transfer notice" is you 797(notice of action). make a copy and send it with the 129f.

another fee is not required.

going the k3 route is up to you :)

since you are at the cali center, you shouldnt experience any long delays, like at the vermont center. although the 130 stand alones do get processed faster. I would check with some vj members at you consulate to see how far out they are scheduling interviewsfor the two. then you can use that to help you make a decision.

good luck

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive, and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Thanks!

You said its the 797 notice of action but in the guide # 10. Copy of the NOA1 from the I-130... (aren't these both the same thing?)

yep, the notice of action(NOA1) and the transfer notice are one in the same.

Another question i had was under B.18 in the guide it states to put n/a under this? Why. I am currently married so is it assuming that i am not?

"Form I-129F: Petition for Alien Fiance(e). This form may be used to obtain a K-3/K-4 visa for your alien spouse and her or his child. Fill out the form as directed, except assume that "fiancé" or "fiancé(e)" means "spouse." answer Questions B.17 and B.18 by stating "N/A." Note that filing this form is only necessary to facilitate the entry of your spouse and her or his child as a nonimmigrant. "

this question is specifically for the k1(fiance visa) so it is "n/a" in your case. I marked "n/a" and got approved

stressful filling them out huh? :)
