Hi guys

Here is my problem.

I applied for an EAD 2 weeks ago (electronically) before I applied for the AOS.

That (EAD) is being processed now by USCIS.

Right now I am applying for AOS and I will also send the I-765 (EAD) form with the rest of AOS documents.

My question is what option should I check off on I-765 form?

There are 3:

- Permission to accept employment

- Replacement (of lost employment authorization document)

- Renewal of my permission to accept employment (attach previous employment authorization document)

I was thinking about the Renewal option, but I do not have yet the previous EAD (did not get it yet)/

on what classification did you apply two weeks ago?

This application filed in conjunction with the I-485 will be C9... It is a new authorization as C9 was not available to you before the I-485 was submitted and or pending

Classification.... hmm. I think I went with I-94.

So with this new EAD that I am doing, I should go with this option:

- Permission to accept employment

?

Since you do not indicate what your status is it is difficult to tell.... What is your current status? The I-94 does not by itself allow for a submission for EAD...

Since it is a new authorization it would be Permission to Accept Employment

I called USCIS about this case, particularly, applying EAD under different eligibility category. I applied for EAD prior to AOS. I had my card and been working. Now that I am filing for my AOS, I am also sending out my EAD --it's free anyway. Even if I already have an EAD, the USCIS lady told me that I should apply for an initial EAD since it is now under © (9) category..and not (a) (9).

02-20-2014 1st Service Request created for delayed biometric appointment letter

03-01-2014 Received 'yellow' letter in the mail

03-28-2014 2nd Service Request created since the 1st request had no response from the assigned Service Center

04-07-2014 Received biometric appointment letter in the mail

04-25-2014 At last, my biometric appointment!!!!

06-09-2014 Interview - recommended for approval!

07-17-2014 Oath Ceremoney USCIS-Orlando Office! I'm A United States Citizen

yes that is correct because it is not a replacement of your current card but a brand new authorization under a different classification
