You'll have to provide evidence of exactly why she overstayed and prove that it was unintentional. You may be able to file a waiver as well. I know there are others in here that can help better than I can though. Good luck

Depending on how long she overstayed she will likely have a bar (3, 5 or 10 years) against her return. However, if her only problem is an overstay she will be able to file for a waiver to list this bar. You should start researching the waiver process. The best place to do so is at www.immigrate2us.net. Good luck!

Definitely go to www.immigrate2us.net and check out their 601 sections. . .there are sample letters and lots of information on the type of evidence you need to support your waiver package.

If it was just an overstay you will need the I-601, if she was deported you will need the I-212 as well. How long was the overstay? Did she enter with a visa or without? Did she enter more than once?
