There's a long tax thread here in another forum http://www.visajourney.com/forums/index.php?showtopic=170514

It more than covers things in detail. Jump in around post #4 and read til the end.

We filed married/jointly while pending AOS/after EAD approval. We waited to file until the SS card arrived.

Is this allowed? During the 2008 tax year I was on F-1 status for part of the year, but then applied for AOS. AOS was approved February 2009. I wasn't sure if I could file married jointly through a regualr 1040EZ. Did you file by sending the form with a letter electing to be seen as a resident for the whole year?

Filed: Citizen (pnd) Country: France

I married in December 2007, filed taxes as married filing jointly in February 2008 and applied for AOS shortly after.

I was unaware of the requirement to file a statement saying that I wanted to be treated as a resident. But it never was an issue, even though my return took a while to go through (probably them checking that I was married and eligible for resident status).

Just my personal experience.

AOS Approved on 10-17-08 (details in profile)

Removal of Conditions on 07-19-10

In this tedious process, we tend to forget that this is all worth it.

I love my hubby beyond anything in this world.
