Hi all

If you are currently adjusting status, what tax form do you file?

Also, if you are a Greencard holder what form?

Just want to figure it out and make sure i'm filing correctly

just realized this was a silly question lol

I guess what I am asking is, is there a specific form or can I just file as married but file separately?

if you are a resident alien for tax purposes, you can file for 1040 either separately or jointly

if you are a non-resident alien for tax purposes, you might need to file 1040NR

How soon after you file does the SS card arrive? Do I have enough time to wait for this year's returns if we just filed AOS at the end of January?

if you file an extension you have till October

Am32, have you received your EAD? If yes, just go to the SSA and apply for a SSN. :)

No, and didn't apply for one, since my spouse doesn't need to work right now. So does that mean I have to wait until I get the green card? Would I still want to hold off on filing taxes until then or does it not matter?

You are not eligible to apply for a greencard until you have work authorization (for you now it is the greencard). As for filing taxes, it certainly is simpler if you wait, but you can choose the course of action you wish

If you did not file for EAD you don't have a chance. The EAD card came in (3) months after we filed, SS card 2 weeks after. <why wouldnt you file for an EAD card when it is free to do so?>

We applied (AOS/EAD) early Feb, filed taxes in May. They owed us money, there was no penalty and we got our refund and stimulus payment. IF: You do not (owe) taxes, you have until Oct 15th to file. You do not need an extension. If you owe taxes, and your spouse's SS card is not in, best file an extension so you can file your taxes a little late. We did not request an ITIN because we would have been penalized on the stimulus payment (no SS#, no stimulus payment last year). Since your circumstances changed, you are eligible this year for last year's stimulus payment IF your spouse has a SS number when you file.

Call the IRS ask for a tax specialist, they will confirm this for you.

I don't think it's free, I think its an extra $300... we didn't file b/c my spouse is a full time student and isn't planning on working.

I don't think it's free, I think its an extra $300... we didn't file b/c my spouse is a full time student and isn't planning on working.

Only when filed alone. It is at no charge when filing in conjunction with or after an I-485.

am32 you can go get a tax id number through IRS website - download and fill out the paper work for getting a tax ID number and then mail it in - then you can file your taxes with your wife as joint. Else you need to wait for green card or EAD to file for Social Security number - Good Luck
