Someone asked recently how long it takes for K-3ers to adjust status. This got me to thinking that it might take less time than those who come on the K-1 and still need the I-130 approved. Is there a simple way to track the K-3 AOS processing times separately? We are trying to avoid another medical and removing of conditions, so would like the best estimate possible.

Thanks!

Moved to AOS forum for best response.

AOS questions are best answered here. Not sure if a separate K-3 AOS forum will add value, but I defer to Captain Ewok for further evaluation.

K-1 only requires an I -485 + supporting documentation, not an I-130.

I am not aware of any appreciable difference in processing times.

Check the processing times here:

My question was purposely meant to be an admin one- about separating out the K-3 and K-1 processing times, to see what the differences are. K-3s don't need advance parole and often apply for their EAD separately, etc., etc., so I thought it would be good for everyone to know if the AOS times are statistically significantly different, as it's makes a difference in the timing decision of when to apply.

I know what you're asking. I wish the search timeline tool included AOS where you could separate out by visa. There's so many different visas that one adjusts from including work, student, visa waiver, etc. I'm not sure the datasource would be so great. I find so many people in the AOS forum don't have a timeline. Many have it in their signature, but that doesn't help the statistical search thing.

I think K1s and K3s may not have too much difference because the AP and EAD process separately at different offices than adjudicating for the AOS. But it would good to be able to drill down timelines for AOS. If that timeline link allows it, I just don't know how to use it.

I'm not great at figuring out the statistics either. Statistics was my worst course in college. All I know is I'm going to try to find some time lines of K-3ers who have entered their dates for AOS to make the best guest as when to apply. I suppose it doesn't hurt to look at the specific field offices, but often there is not enough data for predictive purposes. Those crunching the numbers here take great pride in their work, and for that we are grateful!

Adjustment of status is adjustment of status.

There is no reason for the processing to be different based upon what type of visa (or lack thereof) the applicant entered on.

There are some possible differences in preparing the packet to be sent to the Service (maybe you need a medical, maybe you don't) but otherwise AOS is just plain old AOS.
