Can someone help answer a question about filling out the I-129F after filing the the I-130.

Reading the I-129F instructions on page 4 paragraph 2 are very vague, it says i need documents for Items 1, 2 and 4, but not item 3. but I can't figure out what "ITEMS" are.. I called the USCIS National Customer Service Center and they couldn't answer my question either...

Can someone explain what I will need to send? Do I send all the same documents again? Birth certificates, 325a, marriage certificates..etc..etc...?

and did I read it right,there is no fee if used in conjunction with the i-130?

Hi there,

Instead of cluttering the board with more threads, I thought I could post my questions here since they relate to the topic at hand.

I have done the timeline thing but not sure if it shows? Anyways, I sent in my I-130 form on January 30, 2009 (well, that's when it was received), and just 2 days ago I got the NOA1 (the notice date says February 4, 2009).

I have been reading through this forum and doing a bit of research online and it seems to me that there is much disapproval regarding the K-3 visas. By the way, I'm doing this for my husband, who is in Syria now :(

So, is it pointless to do this I-129F and the K-3?

I'm so lost right now and USCIS, as nice as their operators are most of the time, aren't much help.

Sent in I-130 form: 01/29/09

Interview Date: 11/08/09 (APPROVED!)

Visa in Hand: 11/12/09

POE: 01/30/10 (!!!!) at JFK Airport in NYC... can't wait!

Got the green card maybe 8 weeks after 01/30/10...

Kat,

it all depends on what you want. Im sure you know there are pros and cons with the k3. right now a cr1 at vsc will save you months of waiting to be adjudicated vs the k3 at vermont. See what experiences are at your consulate in dealing with immigrant visas. Ours is "easier" on k visas, so we are persuing the k3 through nvc.

the cr1 will allow your hubby to work right away, but can be longer at nvc than the k3.

it all depends on your consulate, what your priorities are ect. ect.

BUT, as far as the wait time at uscis...the cr1 is now the way to go if you are at VSC>

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

The CR-1 and K3s are completely separate visas. You have to repeat almost everything.

Check on just doing the I-130 and forget about the K3.

To start CRs are immigrant visas and receive their GC and SS card in the mail shortly after arriving in the US.

No need to go thru the $1010 cost, stress and hassle of doing the AOS.

No need another interview or do biometrics.

Not having a SS card can prevent one doing a lot of things such as get drivers license, joint bank accounts etc.

K3s are nonimmigrant visas and have to go thru AOS. It can take a LONG time to get GC. Can be denied and deported also. Rare but the chance is still there.

If the relationship or petitioner goes belly up before the beneficiary has GC in hand they stand an excellent chance of being deported.

At this time if done properly it only takes about a month longer to do the CR-1 or IR-1.

The CR-1 recipient can almost immediately work, get drivers license, joint bank accounts, and anything else where a GC and SS card are required .

PLus can return home without waiting for AP or GC in case of emergency!

K3 visas have to wait at about 3 months for EAD so they can get a SSN.

Petitoner has to qualify financially at the interview and then a few months later at the AOS. Some petitioners have been getting laid off due to the economy causing more AOS problems.

CR/IR only does so once at NVC.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Kat, when my father got married, he was able to file all the paper work in Syria at the consulate there. He brought his wife in 2 months. Why don't you find out if you can do the same? Of course, he got married pre- 9/11. If not, then do the I-130 by itself. It's usually approved faster than when you do the K-3 with it. When VSC gets backed up they are able to send the stand alone I-130's to Cali where they are processed really fast. If you have some circumstances that you think will trigger AP (administrative processing aka reviews, security checks, etc) or any other type of delay, then do the K-3 which some people believe is less likely to be put in AP than a CR-1.

Oh, and don't bother with Pascrell's office. They were useless. Yeah, I talked to the lady you and I discussed before, and she was a big b1tch just like you said. The other one was really nice, but was useless too and gave me wrong information. I contacted all our bretheren that held positions of authority and none of them were able to do anything. Just giving you a heads up. No one will be able to help from our people. Best of luck to you. Inshallah it won't take too long.

Stand alone I130 are being processed much sooner than if you filed both I130 & I129F. We have been waiting 7months +

But if the USC is living abroad you can direct file with the embassy and that takes less time
