so the NEW I-129F forms is still not available????

I see on the IMBRA thread that the new I-129F form no longer has 'provisional' (or whatever the word was) stamped across it--?

Yet when I go to USCIS and bring up the PDF of the 129F it is still the old one.

Anybody know what's going on with that?

Most of the nice folks on the IMBRA thread seem to be those who have already filed and are stuck in limbo waiting for an RFE---but what about us newer folks who are in 'File with the old 129F or wait for the New one?'

limbo?

Do we have any smart people in that group (I ain't one of them for sure) ?

In my humble opinion, I would file immediately.

If you read the USCIS release dated 13 June, it advises that the new form will be available in June....Maybe... I added the maybe!

But it may actually be late.

If you file now, you will get an NOA1 priority date and can then follow up with the requisite information.

The longer you wait, the further you fall behind everyone else who has not been educated on this site.

Does this make sense? I hope so.

Johnta, I know how you're feeling. I'm in the exact situation you are in right now. Should we wait for the new I-129F form or go ahead and file with the current one? I'm NOT SURE, but I guess we need to make a decision and we need to make a decision FAST.

I'm planning on waiting until June 19th (the latest) to wait for the new form. But I doubt it will be posted by then. If the new form isn't posted by June 19th, I'm going to go ahead and file my forms. I've waited long enough on them!

So I guess it's up to us, to decide what to do.

I would go ahead and file if you have everything ready. By filing with the old I-129F, you know you will receive a RFE which will add a week or 2 to your time but at least you will have the process started and you will get your NOA1.

Now, hopefully for everyone here who is waiting, the new form comes out today but there is always the possibility that it won't be available until tomrrow, next week, next month, etc. With all the problems I had with USCIS (I am STILL waiting for my NOA2), I don't trust them very much. I guess it is a choice that you will have to make.

Just my brief thoughts.

Actually right now.. I would wait...

Their website states that they want to get the form by the end of June. You can send it in now, and wait for the time for them to get you an RFE and you to send it back (which could take a month), or you could wait a couple of weeks for the new form and avoid all that. IMHO, anyone who needs to file a I-129F should hold on until the new form comes out... It would likely result in a net gain in processing time versus filing with the old form.

I'm also in the same boat as you.... and after spending weeks on this site educating myself with everyone's extremely valuable insight, I have decided to wait until the end of the month and file when I go meet my fiance in the US on July 1. The current I-129f says it expires on June 30th so I am hopefull (or wishful :hehe: ) that the new form will be available by then. In yesterday's press release, they did say it would be available by the end of the month and I'm thinking it will, I don't think they would have confidently make that kind of statement to the whole world and risk not having it ready.

That's just my 2 cents worth. Bottom line is you have to decide for yourself, personally, the less paper work the better for me, so I would rather only have to fill out forms once!

I'm going to send mine in this Friday.....

My thinking is that if I can send the packet I would atleast get a NOA1 and then get the RFE for the IMBRA stuff. But atleast all my stuff is already there and I"m hoping that since my packet would already be sitting there it would be quicker than waiting for the new form that only God knows when they'll be putting it out.

I am not sure where I saw it but I did read the new form would be availble starting the 25th or 26th of June. One advantage of not waiting is there are probably a lot of people sitting on their hands waiting for the new one and there will likely be an avalanche of new filings as soon as the new form is available. You can get ahead of that now even though the RFE will slow you down.

12/14/2006 Applied for K-1 with request for Waver for Multiple filings within 2 years.

3/6 Called NVC file sent to Washington for "Administrative Review" Told to call back every few weeks. 7/6 Called NVC, A/R is finished, case on way to Moscow. YAHOO!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
7/13 On Friday the 13th we see updated Moscow website with our interview on 9/11 (Hope we are not supersticious) 9/11 Visa Approved. Yahoo.
10/12 Tickets for her to America. I am flying to JFK to meet her there. 12/15/07 We are married. One year and a day after filling original K-1
12/27 Filed for AOS, EAD & AP 1/3 Received all three NOA-1's 1/22 Biometrics 2/27 EAD & AP received 4/12 Interview
5/19/08 RFE for physical that she should not have needed. 5/28 New physical ($ 250.00 wasted) 6/23 Green Card received
4/22/10 Filed for Removal of Contitions. 6/25 10 Year Green Card received Nov, 2014 Citizenship ceremony. Our journey is complete.

Your logic is misguided...

The USCIS uses a priority system policy where earlier cases will be sent for adjudication before later cases...

Let's say that the form comes out next Friday, June 23. If you send in the old I-129F today and it arrives let's say next Tuesday, June 20th. That means in essence that your petition will be sent for adjudication between 3 to 7 days before the guy that waits. Your petition get to the adjudicator and he sees that it was with the old form and immediately issues an RFE. You then have to wait for that RFE to be generated and sent out to you and when it arrives at your house about a week and a half later, the guy that waited until the new form went out is now sitting on the desk. Seeing that it's the new form, the adjudicator proceeds to adjudicate it, approves it, and sends it on it's way to the NVC..

All while you're waiting for your RFE...

Believe me this has crossed my mind and I agree with you. Thing is that we do not really know for sure that the new form will become avail on June 23rd......know what I mean? Who knows for sure when it will be out.

My question here then would be this..... If I send out my K-1 petition tmw Friday. How long aproximatley would it take for me to get my RFE?? I know there is no true way of knowing, but how long aprox has it taken those here to recieve any sort of RFE?? one month? 2 weeks? 3 weeks??

I guess that is the question then for me..... because if it take 1 month until I get the RFE, then maybe I should wait for the new forms and hope they get here by the end of the month.
