Friends,

My wife is currently on a K-3 Spouse visa issued on in the month of November 2007, she landed here in the USA in December 2007, we took our time to file the AOS paper work as our son was born in January 2008 and kept us busy, I did eventually file the AOS paper work on the 13th of August 2008 and have just received the “Initial Interview” Letter with a date of 16th March 2009 for the interview. The problem is that my wife is currently in India visiting her parents and is scheduled to come back in the first week of April. Going thru the Immigration letter, it looks like it is strongly recommended to attend the interview on the given date, I would however like to reschedule for one month later as she still has 7 months left on her K-3 visa and I would like her to enjoy her time in India and not rush back……

Has anyone else tried to re-schedule their “Initial Interview” for the Adjustment of Status process?

Also, what exactly happens during this “Initial Interview” and when is the Green Card actually issued to the spouse (assuming all goes well during the Interview).

I would like to take this opportunity to thank all those in the Visa Journey Forum, it has been a long journey for the both of us, especially the 8 long months before she actually got her K-3 visa were especially trying, could not have done it without the support of the expert knowledge of those on this site. 18th January 2007, Married.

8th March 2007, Sent I-130 USPS Mail.

12th March 2007, I-130 Recieved by NSC, Signed for by F HEINAUER.

20th March 2007, $190.00 Check Cashed by USCIS, Back of check indicates file is with California Service Center.

23rd March 2007, Recieved I-797 NOA1 for I-130 (Had a spelling mistake in Benificiary Last Name).

26th March 2007, Called USCIS about mispelling on I-797; they made a note, gave me a "T" Number, said submit I-129F with current I-797.

19th April 2007, "touched".

20th April 2007, "touched".

13th June 2007, "touched". (Due to Phone Call Enquiry)

14th June 2007, "touched".

12th July 2007, "touched", (Due to Phone Call Enquiry)

15th August, 2007, Approved.

I-129F Petition

28th March 2007, Sent I-129F USPS Mail.

30th March 2007, I-129F Recieved by USCIS Chicago, Signed for by S SANDOVAL.

4th April 2007, $170.00 Check Cashed by USCIS.

4th April 2007, NOA1 Notice Date.

19th April 2007, Recieved Email, my Petition transfered to the California Service Center.

Hey Guys......; Any Ideas, what would be the correct next steps for me ??

Should i call the USCIS Number and what do i hope to get from them, or what should i expect.

If you try to reschedule her interview without it being a life or death situation then expect to get a letter of denial very shortly after the date she should have appeared for interview.

If she is out of the country when the AOS is denied then any benefits that were given with the K3 or application for AOS will be revoked and she could find herself refused re-entry to the USA when she tries to return.

I have seen many people try to reschedule their AOS interview for many reasons, The odd person has been able to reschedule but has ended up waiting many many months for another interview date. The majority of people we have seen on VJ that have tried to reschedule have ended up dinied and then had the cost and stress of trying to get it sorted out.

You should reschedule your wife's return date so that she is able to attend her interview.

Come back early and go to the interview. She can visit her family whenever she wants when she gets her greencard.

The other option is to try to reschedule. But if something goes wrong with that (it's USCIS so it probably will), she may be visiting her family in India permanently.

If I'am in your place , I will suggest to come back for the interview, It's very important and I don't think you can re-shedule the intial interview.because many fields offices they are back up. I want juste to ask you about your case ,is your case before the interview in the national benefit center in Missouri?????. me I filedmy AOS(k3) in august 25 my case is in Missouri, and I still waiting for interview, I,m worried a little.good luck for your interview.

If I'am in your place , I will suggest to come back for the interview, It's very important and I don't think you can re-shedule the intial interview.because many fields offices they are back up. I want juste to ask you about your case ,is your case before the interview in the national benefit center in Missouri?????. me I filedmy AOS(k3) in august 25 my case is in Missouri, and I still waiting for interview, I,m worried a little.good luck for your interview.
