The letter of denial should also have instructions on how to proceed further. Anything mentioned about a motion to re-open/re-consider (MTR)?

It would be a good thing for you to set-up an infopass, take everything that was required in the RFE with you, all documents that you have.

yeah, and the fee for that is $585.

it pisses me off that we have to pay for them not completing their tasks properly. :ranting:

I am not sure I have this straight. They asked for more financial information, correct? You sent in everything that was on the initial request, correct? So what it was denied on was never requested from you?

Am I understanding you correctly? Because if you sent in everything, and you have proof, then you could contact the ombudsman. He will review your case, and if he feels that you provided enough information to have a case against the USCIS he can assist you.

Make an infopass appointment at your local office and find out why you got a denial. Could it be that you did not send what they were looking for or is it just a mistake on their part? The only way to find out is to visit the local office and speek to a immigration officer.

The People at the 1-800 line are not USCIS staff they are a call center and they use scripts to answer your questions so unless it is a very basic question they do not know and even then they get the basic stuff wrong all the time.

I know what the problem was. They didn't get some of the federal income tax documentation, but my question is why in the world didn't they contact us to say that it's missing and awited instead until it was too late.

Why???? Because!!!! That is answer Because!!! This is an answer. If you will forget to send something or sign any document, what will happen??? I will tell you, YOU WILL PAY FOR IT!!! How? By waiting few more months….Ok Now look. If any of American’s worker in USCIS will forget something to send, sign, if they will last your case what will happen then??? You will pay for it bubububhahahahahaha …. How? By waiting few more months. Why it is like this BECAUSE it is USCIS With Stupid American’s workers and that is THE END !!! People please open your eyes look on your country and then you will see why USCIS is working as it is…..

I imagine it is not pleasant at all, and I don't think you can re-open/ask USCIS to reconsider your file without paying, but for sure you must pursue it with an infopass. Maybe the US spouse should also start calling the congressman/woman? The Ombudsman?

Bottom line, there is something to learn from your case: don't let 60 days without a change in your application status GO without calling USCIS about those applications. Very sad. I hope you'll solve it soon.

11/17/08 : Application sent (I-130, I-131, I-485, I-765)

11/18/08 : Official receipt of documents stated on I-797C (Signature for receipt at USCIS was on 11/17/2008 at 10PM)

11/28/08 : NOA Received ( I-797C) for all 4 forms (forms issued on 11/26/2008)

12/18/2008: LUD on I-130, I-131, I-765

01/29/2009: Bio done

01/29, 30/2009: LUD on I485 and I765

2/10/2009: issued AP, valid 1 year for multiple entries.

2/23/2009: Got EAD card

3/8/2009: LUD on all applications. Shows approval of I131 and I765, still pending on I130, I485.

04/28/2009 at 9:30 AM: Interview. Told to wait 90 days for a resolution by mail.

05/01/2009: Card production ordered.

05/06/2009: Received approval NOAs for I130 and I485 (welcome notice, 10 years card). I130 still shows case received and pending.

06/18/2009: got the 10 years validity card. Process length: 213 days since sending the applications.

No RFE at all along the process.

It's almost ironic, because i've been calling at least four times for the past 3 weeks.

It's almost ironic, because i've been calling at least four times for the past 3 weeks.

I havn't been waiting.

There is no fee for the reconsideration. Give them what they need & see what happens.

As to the Polish guy; I am stunned to know you are leaving such a well run country to move to this screwed up disaster we know as the USA. Dont do it. Stay there & let us know what we can do to move over there before its too late. Just a quick review of Polish history brought me to my senses & I am applying for my visa right now. Leck Walensa forever. What happened to him?

Make an infopass and go talk to USCIS about this situation. But do it very calmly and have bring a good attitude.

USCIS has done a great job on my case. Had only one problem and it was correctly very quickly. They process a ton of applications and mistakes will be made.

Here is the short story:

september 22: sent AOS paperwork

october 7: received an RFE

october 22 : USCIS received more evidence and updated my case:

Response to request for evidence received, and case processing has resumed

3 months and 3 weeks later(today) i got a letter of denial, because i had 87 days to submit evidence and i never did(#######???).

So we sent all of the financial #######, but missed something.

I've called them about 4 times in the last four weeks, none of them goddamn f**rs said anything about any papers missing.

What's gonna happen now?

Do we reapply? Do we pay another ridiculous fee for the AOS?

Please, help, i'm desperate!

same thing happened to us. and our file was put on "abandoned" status.

we waited for an RFE that never came. and we kept calling and they kept saying wait for 30 days. but still no RFE.

so he called and called and called... only to find out, our file was no longer inactive and was now an abandoned case.

i dont know what he said but he was so pissed that he just cut them off.

then lo and behold, a USCIS supervisor (he said he was) called my fiance back and apologized and told him that the would activate our file again.

and when ask why it was on abandoned status, he said - because we never called USCIS to update our file.

now #######. :angry:

but oh well, we finally got the RFE in the mail which was total ####### cos they just wanted more pictures. we already sent tons when we applied.

anyhow, i hope things get straightened out on your application.

keep calling USCIS... who knows

By the way, when you called USCIS, did they place a service request for you, or just kept telling your applications' status? Do you have a reference number for such service request (s) ? This would definitely prove you were actively seeking/interested in the file's processing (not that simply by sending the applications and responding to the RFE you would not prove it).

Until now, I never thought one needs to document each step of the way, but the more I search, the more I see the system's cracks and how months of your life go by just because someone screws it. Just because they can. Just because they don't pay the attention they should. Just because they don't do their job. The job for which the USC spouse pays taxes. :huh:

Get your papers in order, get yourself together, leave the anger aside and go plead your cause.

Yes, the confirmation of the inquiry came with the denial letter, what a #######!

I'm going to send some letters and more financial papers tomorrow without any checks, i'll see what will happen.
