Here is the short story:

september 22: sent AOS paperwork

october 7: received an RFE

october 22 : USCIS received more evidence and updated my case:

Response to request for evidence received, and case processing has resumed

3 months and 3 weeks later(today) i got a letter of denial, because i had 87 days to submit evidence and i never did(#######???).

So we sent all of the financial #######, but missed something.

I've called them about 4 times in the last four weeks, none of them goddamn f**rs said anything about any papers missing.

What's gonna happen now?

Do we reapply? Do we pay another ridiculous fee for the AOS?

Please, help, i'm desperate!

I do not think that USCIS is STUPID, but I am sure that PEOPLE WORKING THERE YES THEY ARE STUPID AND LAZY!!!!. I wrote onece about American’s working there….and heheheh ……

Make an infopass appointment at your local office and find out why you got a denial. Could it be that you did not send what they were looking for or is it just a mistake on their part? The only way to find out is to visit the local office and speek to a immigration officer.

The People at the 1-800 line are not USCIS staff they are a call center and they use scripts to answer your questions so unless it is a very basic question they do not know and even then they get the basic stuff wrong all the time.

I know what the problem was. They didn't get some of the federal income tax documentation, but my question is why in the world didn't they contact us to say that it's missing and awited instead until it was too late.

Why???? Because!!!! That is answer Because!!! This is an answer. If you will forget to send something or sign any document, what will happen??? I will tell you, YOU WILL PAY FOR IT!!! How? By waiting few more months….Ok Now look. If any of American’s worker in USCIS will forget something to send, sign, if they will last your case what will happen then??? You will pay for it bubububhahahahahaha …. How? By waiting few more months. Why it is like this BECAUSE it is USCIS With Stupid American’s workers and that is THE END !!! People please open your eyes look on your country and then you will see why USCIS is working as it is…..

My opinion about USCI is NON OPINION why? Because everything from them is stupid. Even if they will send me NOA2 after 6 or more of waiting, my opinion will not change about them, but my opinion about American’s workers, working there has been changed soooooo much since I sent my form to USCIS :devil:

made an infopass appointment at your local office.. talk to the IO there and ask them what to do.

If you miss any documentation, it is better for you to write a personal note and let them know what are you going to do for that (for example, you have submitted a request to get a copy of W-2s, 1099s, etc). Then they will wait for that and your case will be resumed but you really need to send all the info to them.

Let me understand this, you responded previously to an RFE but according to your denial letter, you just now learned that the response was not sufficient... Do I have that correct?

BryantAliona, I am so sorry that all this is happenning to you! Unfortunately, as was said above, we have to pay for their stupidity and mistalkes! :ranting: What i would suggest you to do:

1) call USCIS (even better if your husband calls) but ask (or demand) to talk to the superviser (or immigration officer). Those customer representatives don't know a s***, they are just like robots and tell you the information that you already have. Insist on talking to the person who can really have a look at your case and hopefully will be able to tell you waht ypi need to do.

2) make an appointment at local USCIS field office, bring all the paperwork with you and explain the situation. They can always contact NBC for your case.

Be active and persistant, don't let it go! I hope everything will be straightened up in the nearest future and wish you the best of luck!

6 December 2008 - our wedding!!!

3 January 2009 - AOS package sent to Chicago lockbox

5 January - document received by USCIS

8 January - 3 NOAs issued (485, 765, 131)

12 January - NOA hard copies received by mail

13 January - AOS, EAD touched

19 January AP touched

10 February - placed a service request regarding biometrics appointment

23 February - biometrics appointment issued

11 March - AP approved and approval notice sent

14 March - biometrics at San Marcos ASC

16 March - EAD card production ordered

16 March - AP received in the mail

16 March - AOS touched

26 March - EAD received in the mail

9 April - Invitation for the interview received in the mail (issued 6 April)

13 May - AOS INTERVIEW!!! APPROOVED!!!!

15 May - Card production ordered!

21 May - Welcome Notice received in the mail

15 June - Card production ordered again

22 June - Green Card received in the mail!!! Woohoo!!! (dated 13 May 2009)

The letter of denial should also have instructions on how to proceed further. Anything mentioned about a motion to re-open/re-consider (MTR)?

It would be a good thing for you to set-up an infopass, take everything that was required in the RFE with you, all documents that you have.

11/17/08 : Application sent (I-130, I-131, I-485, I-765)

11/18/08 : Official receipt of documents stated on I-797C (Signature for receipt at USCIS was on 11/17/2008 at 10PM)

11/28/08 : NOA Received ( I-797C) for all 4 forms (forms issued on 11/26/2008)

12/18/2008: LUD on I-130, I-131, I-765

01/29/2009: Bio done

01/29, 30/2009: LUD on I485 and I765

2/10/2009: issued AP, valid 1 year for multiple entries.

2/23/2009: Got EAD card

3/8/2009: LUD on all applications. Shows approval of I131 and I765, still pending on I130, I485.

04/28/2009 at 9:30 AM: Interview. Told to wait 90 days for a resolution by mail.

05/01/2009: Card production ordered.

05/06/2009: Received approval NOAs for I130 and I485 (welcome notice, 10 years card). I130 still shows case received and pending.

06/18/2009: got the 10 years validity card. Process length: 213 days since sending the applications.

No RFE at all along the process.
