Canadian Marrying US Citizen

Timeline

I'm a Canadian citizen residing in Canada and I am marrying a US citizen currently residing in the U.S. I have a few questions. From what I have read it seems that the K-3 route is the quickest to obtaining a green card. Please correct if I am wrong. Also can I go through the DCF route if she lives in the US, I have a feeling I cannot in Toronto. Once the initial step of the K3 process has started (sending in the I130 are there restrictions as to me visiintg her in the US and is it possible down the road while awaiting for approvals for me to live unemployed in the US with her. As a Canadian I know I'm not bound by the same Visa requirements that other nations are regarding being in the US. All help is much appreciated. Thanks.

DCF is when the USC lives abroad... Toronto will not be your consulate... it will be Montreal

If you are not yet married you may want to consider K1, but this all depends on when you want to get married. See the guides at the top of the page, they also give some K1 (fiance) vs. K3 vs. CR1 (both married) information that may be helpful to you.

10.23.08 - sent K1 packet

10.29.08 - NOA1

02.19.09 - NOA2 113 days, Igor's #226

04.13.09 - Interview, Visa in hand next day

04.19.09 - POE Atlanta

04.20.09 - Married!

AOS Process

06.09.09 - sent AOS,EAD,AP packet

06.17.09 - NOAs issued

06.24.09 - Biometrics done (3 weeks earlier than appt date)

07.03.09 - received RFE for I-693 (dated 6.29, responded 7.07)

07.23.09 - transferred to CSC (received letter 7.27)

07.29.09 - EAD Card Production Ordered & AP Approved

11.23.09 - AOS touched - card production ordered & welcome letter sent - 13 months exactly after initially applying for K-1!

12.03.09 - GC arrived in mail

Removal of Conditions Process

07.28.11 - received reminder letter from USCIS to remove conditions before 11.18.11

09.28.11 - mailed I-751 packet

10.03.11 - NOA

10.05.11 - check cashed

11.25.11 - Biometrics

07.24.12 - GC approved!

08.01.12 - GC arrived in mail

Citizenship Process

12.16.16 - sent N400 packet

12.23.16 - NOA issued

01.27.17 - Biometrics done

02.01.17 - put in line for interview

03.15.17 - scheduled for an interview on 04.21.17, had to write a letter asking for a reschedule because we will be out of the country

03.31.17 - scheduled for an interview again

05.09.17 - Interview!

If you're in the East of Canada (Ontario and onward) don't bother with the K3 at all, go straight to CR1. CR1 is an immigrant visa (same as green card status) and allows you to work pretty much as soon as you arrive in the US. K3 you would have to apply for EAD after you get there, and be unemployable for several months. The K3 and CR1 are taking about the same time to process in Montreal, and the K3 costs more, so CR1 = superior visa.

Yep, no DCF, Montreal and a CR1 visa. Visiting after filing is the most FAQ. Knock yourself out.

Given the current processing time frames - CR1 would be the way to go.

You can visit the US while your visa is being processed as long as you can prove your ties to Canada.

You would need to show that you live and work in Canada.

I travel across the border a couple of times a month to visit my hubby and have never had a problem over the last 2 years.
