Is there any way around a co-sponser?

My(USC) yearly salary is about $3,000 less than I need to be 125% over the poverty line. If I could find him a job, and have an employer write a letter saying he would start and X date and make X per year.. and then the both of us combined made it over the 125% mark, would that suffice?

Or what if I just had an in sane amount of savings??

*sigh* I'm just really desperate here... we've been looking for a sponsor and haven't had any luck so far. We want so bad to be together, but at this point that would mean me going to Venezuela, which, of course, would only get us farther from the 125% mark.

you can use savings and assets as collateral.

I am not sure about a letter "guaranteeing" employment for your fiancee would work because there is no guarantee when he arrives in the US of him getting the necessary stamp in his passport temporarily allowing work. You would need to file an EAD which takes approximately 3-4 months to receive from date of petition. This form is typically filed jointly with the AOS after marriage, which is much farther down the road.

12-14-07 Sent K-1 petition

12-17-07 Received NOA1

01-06-08 Got engaged!!!

02-21-08 NOA2 Approved

02-27-08 NVC processed petition

02-28-08 Received NOA2 in mail

03-03-08 Consulate in Rio de Janeiro received petition

03-21-08 Received packet for interview

04-22-08 Visa Interview and Visa APPROVED!

05-06-08 Visa received in mail

07-28-08 Wedding Date (Reception was 26th, but forgot to reigster for MC...oops)

10-04-08 Applied for AOS (EAD and AP also)

10-09-08 NOA1 for I-485

10-27-08 I-485 transferred to CSC

11-04-08 I-485 Biometrics appointment

11-13-08 NOA1 for EAD

12-09-08 EAD Biometrics appointment

01-08-09 AP Approved

01-13-09 AP Received

Cost of 3 roundtrip tickets to Brazil in last 3 years...... $2,900+

Cost of filing petitions for K-1 visa & AOS.................... $1,465+

Cost of monthly calling cards to Brazil........................$20

Cost of marrying the woman of my dreams.... PRICELESS

You could get another part time job to increase your annual earnings. Another $100/week would get you above the line.

This will not work for the K-1 or K-3 visa. You will need a co-sponsor. Income of your fiance CAN be used for the AOS, when you do the I-864, also the fiance's assets can be used for the I-864 but not for the I-134

You are several months from filling out an I-134 so you can increase your income. Saving can be used but it takes $3 in savings to make up $1 in income shortfall.

You probably don't understand that when/if he gets to the US, he will not be allowed to work immediately. You have to first marry, thn file for his green card and work authorization which costs $1010. Then you have to wait months to get that work authorization. There's no way you could know he would start work on x date.

Thats not true....depending on his POE...if given a work stamp as my husband was given at JFK...he was able to work the week he got here.

By "this" do you mean me getting a part time job or were you talking about my original post?

Here's the thing! I actually have two jobs now, one full time job as a receptionist that gets me $15,360 per year. I also have a second job as a waitress- as it is I'm only working about 4-8 hours for them per week, which I would be making at least minimum wage($6.55) If I work 4 hours per week I'd get $1,257 more per year. If I worked 8 hours I'd make $2,515 more per year.

How would I state my income like this with a job that has tips?

Technically I make $2.35 per hour

The rest I make in tips, it could range up to $14 an hour, but it all depends.

Legally, my employer is required to make up the difference if I don't get at least minimum wage, so that much is guaranteed. What should I do?? =/

So you would need approximately $9,000 in savings to account for the missing $3,000 X 3 years.

Really?? So me making $15,000 yearly and having $9,000 would be enough?

It would be enough to meet the minimum requirements.

By that you're saying there is still a possibility they could turn us down for financial reasons?

Yes. A Consular officer is charged with judging whether the beneficiary is likely to become a public charge. They are not bound to a positive conclusion based on meeting the minimum standard. They do tend to make allowances for young people particularly if the petitioner is about to finish college but no gaurantee. Again, the I-134 is several months down the road. There's not even a petition filed yet.

Are you saying you think we should go ahead and file? And cross the financial bridge when we come to it?
