Sponsor Q for my Husband

Hi all,

I have an important Q about my case. I am 21 and my husband 25. I have been living with him in egypt for almost 4 months now ...this is my second visit. We were just married 2 weeks ago and i plan to stay here until his interview, but right now we are waiting to see if he is wanted for military. If he isnt, we plan to do DCF. His sponsor will be my parents...my dad just stopped working due to health problems and my mom recently retired from her state of texas job...but she still works for them as a contractor...but they meet the 17,000 dollars requirement ...my question is, about my mom being a 'contractor'...is it still ok for her to sponsor him/? She will need to have a letter from her supervisor or what? I am also confused about domicile..I think that would be my parents' home since I am still a college student? There would be 5 ppl living in my home if my husband is included so 17,000 dollars is the amount my parents need to show at least or wht is the number? We greatly appreciate any advice

Poverty Guidelines

2006 POVERTY GUIDELINES*

I think if you use your parents as sponsers.. and if you live in the household. that is mom, dad, you, your spouse.. would be 4.. for a DCF.. I130 isnt it a total of $25,000 necessary? For a K-1 it would be 100% of the poverty level.. for all other Immigrant Visas it is the 125% figure that is used.

If you sponsored yourself you would be needing to have a income of $16,500 for a household of two. you and your husband.

Be careful of the amount of psons in the household.. each year the list changes.. the above is the posted 2006 poverty guidelines posted bu US Govmt.. click on the link it will give you alot of information to read on for sponsors..

congratulations again on your marriage!

First, I recommend the DCF Guide; it has all the essential links for the I-864 in there. They will help you a lot! Please read the 3 I-864 links in there for info on filling the form in AND domicile.

Now, you will always be your husband's Sponsor. If you do not have sufficient income or assets, you can have a Joint Sponsor. That is the role ONE of your parents takes on. Don't worry, the other parent can participate too. That person will be the Household Member on the Joint Sponsor's form I-864. (The Consulate will likely require YOU to complete an I-864, even with no income).

If you parents live together, 17000 will not be enough. The Joint Sponsor must count everyone in his household and add the immigrant (your husband). If your parents are married & live together, you are up to 3 people minimum. If you will also be living with them, they are up to 4 people. Check the Poverty Guidelines for the new numbers.

Your mother being a contractor will not be a problem; she will use different papers to document her income.

Oops, reading on, you are up to 5 people now (brother or sister at home?). Please go to uscis.gov and find I-864P--that is the Poverty Guideline grid that will show you how much income your family is going to need to sponsor your husband.

Thanks for the replies so far...Im in egypt now...but I have several questions..

my mom would be the one sponsoring since she is the only one working and she might meet the income requirement exctly i hope...but is even that enough to satisfy the CO?

I was planning to do direct filing and we have a straight case I beleive....but...

would it be better for me to go back to usa and get a job and have my own apartment? In doing this, I think I would only need my sponsor(still my mom) to make 17000 dollars but my income would be low pay and I dont know if that would ruin my ability to file directly DCF. The requirements i think, are that u must be resident of egypt and/or not leave the country after you were married...

My last question is about DCF in egypt...is it possible to get the approval that i can file the petition and then return home and get my own apartment and job and then come back to egypt at the interview and present the affadavit of support and it will be like 17,000 dollars since at that time i would have my own apartment and we would only count us as 2 ppl? I feel very confused if you can help advise we would be so thankful..

ahmkri,

Meuxna is correct in that YOU are the sponsor regardless of income, not your mom. Therefore, you will fill out the I-864. I lived overseas without a paying job and still had to sponsor my husband. Your mother can be your joint sponsor. In addition to income, don't forget that assets can help, as well. So, if your mom barely meets the guidelines but meets more than 5 times the difference in assets(eg. home), then she should include this with her I-864.

If DCF in Egypt allows you to return and get a job/apartment, that may help. I am not familiar with their requirements. You may find some help on the North Africa/Middle East forum for specifics to Egypt. Otherwise, do what you plan on doing by having your mom as a joint sponsor. Meaxna's tips are very helpful.

From what I've read from others, you should not leave Egypt before you file the I-130 or you will not be allowed to file it with them. Typically, once the I-130 is filed abroad and accepted, the USC can leave--the visa interview is for the foreign spouse. I don't know if there is any local reason you'd want to stay for the visa interview.

If you decide to live separate from your family and still have your mother for a JOINT sponsor, she would count everyone in her household plus the immigrant. Based on your earlier tally, that would still make a household of 4 for her (you would not be counted in).

My question is: why would I be included in her overall household income? I haven't lived there since I moved to Germany nearly two years go. Plus, I can use public benefits. Wouldn't it be okay, for the Aff of Support, to have the "Total Household Size" listed as "2." If I'm following the form correctly, there is no way for me to even be in this household.

Moreover, we don't plan to ever live there. We're using her address for domicile purposes until we're actually able to go to the U.S. and find our own apartment in a completely different state. Other than that, she's just a sponsor.

Any ideas?

It is an interesting quandry you find yourself in. Just out of curiosity - do you maintain a US drivers license? Voter registration? Bank accounts? What US address is associated with these things? What address is on your US and state tax returns?

If your mother's house is your place of domicile - your place of residenc in the USA when you are not abroad - then you would seem to be a member of her household even if you are not physically there at the moment.

One idea - get yourself a different place of US domicile?

(We do not have an apartment yet in the state we plan to move to. It's unlikely we can make two trips to the U.S. in order to find an apartment. Hence my mother's domicile is being used.)

Mostly all of the items you listed are connected with her address. I'm just not sure what she should write on the Aff of Support now because I thought if she wrote that the "Total household size," was "2," it would be accurate.

"B. Sponsor's Household Size

1. Number of persons living in your residence, including yourself" -- I don't see how she could include me here in this household when it's rather clear that I live at another residence in Germany. In fact, I'm "registered" as living in Berlin, Germany as I have a residence permit, health insurance, a bank account, etc. I haven't lived in her house since 2004 and I'm not included as a dependent on her taxes. (And I'm not required to file taxes since I haven't ever earned enough income to do so as a student.)

I'll go through the archives and see what others have written because I need to let her know as soon as possible so she can send me the I-864 with the correct information.
