Emergency and Urgent!!!! ( green card in process ) current k1 visa in seattle wa

Need help on anyone who has had this experience in the past...or anybody that know about this.

Not enough detail here...what do you mean by 'green card in process'? Has the marriage occurred? Has AOS been applied for? If so, was the AP petition sent in along w/ the I-485? The AP, advance parole is what allows you to leave the country while the I-485 is being adjudicated. If that is not in hand, and the beneficiary leaves the country, it invalidates the pending I-485 application, and you have to start all over, but this time with an IR-1/CR-1 petition for a spousal visa.

marriage has already happened...my wife now ( fiancee' visa holder ) has already applied for Adjustment of Status and we are currently waiting on the approval of the application. She mentioned that in her seminar they talked about if there is an emergency or death in the family she can go back but we really don't know the details on how to do this. Our current timeline to leave the country ( USA ) is within 2-3 days. Is there a chance she can fly home?

She currently have these status:

SSN Holder

EAD Holder

Has a state ID, W2 filed already...

Just need to know how to do this...any advice is appreciated, thanks!!!

If she leaves the country without advanced parole being granted she will be refused readmission when she tries to reenter. You can file an expidited request for AP at your local office with info pass. It might also be a good idea to get your senator or congressman involved.

I understand this is a bad time for both of you but she must not leave the country until the AP is granted.

Nope... they have been known to do it

I got emergency AP from the Seattle office when my Mom was in the hospital and I needed to get back to Canada to arrange for a nursing home for her when she got released from the hospital.

I had already applied for AP when this happened, but I had not received my approval. So, I made an Infopass appointment at the Seattle office and took a copy of all my AOS documents (including AP) with me as well as a letter from my Mom's doctor, explaining her condition and the fact that I needed to be there to make arrangements for her upon her release.

I was granted emergency AP the same day, although I spent a very long time waiting at the Seattle office for the the approval.

I would make an appointment at the Seattle office (or whichever local office is closest to you) and take any evidence of the death with you and see if you can get the AP approved immediately.
