WoW is all i can say and what a pickle you have all landed yourselves in............uscis will have a field day with this thread, so will the cops, so would anyone with half a bloody brain, this should be locked and thrown in the trash bin and a proper thread like we used to have with correct info should be posted

I was wondering, is there any central DMV site (except DMV.org) where you can find your state are all they state specific? I'm having trouble finding stuff on foreign drivers in AL.

Google is your friend. Requirements on this page under Non-U.S. Citizens http://www.dps.state.al.us/DriverLicense/pdf/ApplyingDL.pdf

Looks like you will have to wait on at least the EAD card, if not the green card to get a license in AL because your legal status as shown on your I-94 will only be 90 days and not long enough to get a DL.

This is the whole 88 page driving manual http://www.dps.state.al.us/DriverLicense/m...riverManual.pdf

You will find this info:

AN ALABAMA DRIVER LICENSE IS NOT REQUIRED FOR THESE PEOPLE

  • A resident at least 16 years old who has in his immediate possession a valid driver license issued to him in his home state or country. This

    includes military personnel from other states and their families stationed in Alabama, even though their assignment in Alabama may be of long

    duration.

  • A non-resident who has a valid driver license from the state of previous residence may drive without an Alabama license for 30 days after becoming a resident of the state.

So it looks like by rules of those who accused others of lying, you can drive for 30 days. Then you stop and wait on your green card according to the second bit because your become a resident of AL when you POE.

Or if you go by "liars" train of thought, you drive using the first bit because neither the US government, nor the State of Alabama has given you anything on paper saying you are an official resident. If you're not an official resident, then are you still a visitor?

It's not a black and white, truth or lie issue. It's a gray area subject to interpretation. That's why the US has the whole judicial system...to interpret laws that don't say clearly one way or another or to rule where two laws conflict. Not many things are black and white.

Thanks Nich, that's really helpful. I found the first link this morning and plan on emailing them. Do you think I would come under the part I bolded as I will become a military spouse once married?

No, from a US perspective that became void at the point he failed his test. He has been tested and he is not deemed competent to drive (how he managed that is anyone's guess). If he has an accident while driving illegally, well, you know the rest.

He needs to learn how to drive like an American and get it done!
