Hello I am new here and I have a few questions. I met my beautiful fiance several years ago but we are just now getting ready to go through the K-1 process. I will be traveling there in a couple months to visit her. I have been looking over everything required for the K-1 visa and I intend to get a lawyer to help with the process. My question is with sponsorship. I live with my parents at the moment and we recently moved so I had to quit my job. I was only working part time so not making much money. I am trying to get a new job here but i'm worried I won't make enough money to be the sponsor for my fiance.Will me living with my parents and being on disability prevent her from getting the visa? I'm so worried about it. I read I could get a co sponsor and i have several family members that could help me out. I know by the time she would get here I would have a steady job full time but i doubt I would meet the 125% income amount. I know my family would help co sponsor her till we got married and she became a citizen. I mean once she is here and married we will both have jobs and make well enough to support ourselves. we could have our own place but my fiance said she would actually like us to stay with my parents for just a little bit so she would have some people to talk to and all while i'm at work. So basically will me living with my parents and not having my own place prevent her from getting the visa? Also would me not making much money and currently being on disability be an issue? I really appreciate any answers. I thank all of you in advance.

Co Sponsors are allowed in PI most of the times.

Sounds like that may be your best option if you don't meet the poverty guideline.

Really a waste of time and money in most cases.

Read some threads on here about lawyers and make your own decision.

You do not need an attorney. He can only increase your costs and delay the case.

Arrange a co-sponsor ahead of time

I kinda wanted a lawyer because I know if I mess up on any of the paperwork it could mean long delays and I want everything to go smoothly without having to worry the whole time if I messed up on a little part. to me it would be worth the extra money to make sure my fiance gets here without me having to constantly fix mistakes and send the paperwork back. I might not make mistakes but I more than likely would since theres a lot of paperwork and i've never done it before. My fiance is also very nervous about all of it too, she doesn't want to mess anything up. I appreciate all the replies so far. Does anyone know if using a co sponsor will lessen my chances of success?

A cosponsor should not lessen your chances of success.

We considered using a lawyer, but you should really read around on here. I have read more bad things than good things about lawyers. It means additional wait time because instead of sending things directly to the USCIS, you send them to the lawyer then wait for him to send them off. While the waiting is difficult, filling out the forms really isn't and I am astonished that lawyers can get away with charging thousands for their assistance. I think you will find many, many people on these boards who just read the guides, posted any questions they had in the appropriate forums, and were approved successfully. We're one of them! Of course, it's ultimately your decision.

04/08/09- NOA1 for AOS and EAD (we didn't apply for AP)

04/22/09- Case Transferred to CSC

04/24/09- Biometrics Appointment

05/22/09- EAD card production ordered

05/29/09- EAD approval notice sent

06/01/09- EAD arrived in the post

06/18/09- I-485 RFE notice via email

06/25/09- I-485 RFE notice via mail

(They wanted him to redo medical exam- they must've lost it. They also wanted a copy of our marriage certificate, even though we included that in our original submission.)

07/03/09- Medical exam (second one this year grrr!)

07/06/09- I-485 RFE response mailed back to CSC via USPS

07/08/09- I-485 RFE response package delivered at CSC

07/10/09- I-485 Case Processing Resumed (CRIS email)

07/16/09- I-485 Card Production Ordered

07/21/09- I-485 Approval Notice Sent

07/24/09- Green card received in the post!

I agree, my fiance now husband hired a lawyer too when we filed k1 visa and the fee was $1800, they will just send your application forms which ofcourse u can do it on your own.. I think lawyers are for those with complicated situations but i think you will be fine without just keep on reading especially here on VJ.. This website is really helpful infact if we ever find this website earlier before we wont hire immigration lawyer anymore and can save 1800 for adjustment f status. Believe us lawyer is just a waste of time and money... we've been into that.. Just whenever you have query just post your question and VJ members will answer you.. Just a suggestion.. Good luck!!!

:) I know you feel worried that u'll mess up the papers and wanted things to go smoothly. We all feel that way, in fact that was why my husband and I hired one. However, the lawyer and his staff delay things more than smoothen things out for us. The only thing they do is to fill in the forms for us, but where do they get the info from to fill the form? Us. they send us the forms (which we can download ourselves on the website!) and then i fill it up and then send back to them and then they type in it. And often with errors (even after I corrected them!) that when they send back to us for me to sign, it irritates the hell out of us. We were paying a lotttt of money just to pay some glorified form filler who add to our problems/high blood pressure ;) If only we stumble upon VJ much sooner.. :) I think you both should spend your money on meeting each other more than just once (plus, if im not mistaken, up til now you havent even met once! :) make a couple of trips, thats way better way to spend your hard earned money, to get to know your other half better). IMO. In my case, the only good thing the lawyer advised us was to go thru the CR1 visa instead of K3 visa (coz we are married b4 even thinking re filing). Other than that, he cost us his fat fee, lots of courier charges, delays (thanks to him i got RFE-d coz I didnt have my NBI clearance). However, i thank God that our case move along quite fast, but we know it has nothing to do with him!

My friend used one also, and it was the same result. He was LIVID that the lawyer never told him about the G325A forms, and the NEED for the fiance's original signature. Thus, more delays, and money in FedEx fees to get the docs there and back quickly.

I read everything I could, and posted a few questions. Did it myself, and feel confident that the didn't screw it up.

Even if I get RFE'd, I don't see that adding any more time than I would've needed in hiring someone.

I would encourage YOU to feel confident also. Afterall, that money you would budget for an attorney could be better spent enjoying your time in the RP with your loved one. In 11 days, I was able to spend over 2K, and that was without being too extravagant, IMHO! Remember, unless your fiance' is a professional career person there, or from a wealthy family, expect everything to be on YOU. All lodging, meals, transportation, gifts {not just for her, but immediate family}, etc. Plus, you may find her family with a 'need' or two when you arrive that just tears at your heart. Your fiance' may not have told you, either, out of pride or shyness. A leaky roof, or a broken refrigerator, or even something as simple as a nice foam mattress to sleep on may pop-up. Trust me, if you find that you really do love her, you'll want to help out within your means.
