USCIS reminder to remove conditions?

Mail was waiting in the mail box - didn't expect anything from USCIS but I got this:

The records of this Service indicate that you entered the United States as a conditional permanent resident on 5/31/2007. In accordance with Section 216 of the Immigration and Nationality Act you must file Form I-751, Petition to Remove Conditions on Residence. Failure to do so may result in the automatic termination of your Status. You can obtain Form I-751, as well as filing information and fees, from www.uscis.gov or call 1-800-375-5283.

It has my file number which seems to be my A# (haven't checked).

I thought USCIS did NOT remind us to lift conditions - my window opens around March 8th.

Question, when I received my GC, it came on a paper with a bar code and it said to use the top portion of the paper with the bar-code when applying for new card. Anyone used this and does it speed up the process?

You are the third one I know who posted regarding USCIS reminding to submit I751. It sounds weird but there is nothing wrong with it.

The notice is actually prescribed by law:

From INA 216

(2) Notice of requirements.-

(A) At time of obtaining permanent residence.-At the time an alien spouse or alien son or daughter obtains permanent resident status on a conditional basis under paragraph (1), the Attorney General shall provide for notice to such a spouse, son, or daughter respecting the provisions of this section and the requirements of subsection ©(1) to have the conditional basis of such status removed.

(B) At time of required petition.-In addition, the Attorney General shall attempt to provide notice to such a spouse, son, or daughter, at or about the beginning of the 90-day period described in subsection (d)(2)(A), of the requirements of subsections ©(1).

© Effect of failure to provide notice.-The failure of the Attorney General to provide a notice under this paragraph shall not affect the enforcement of the provisions of this section with respect to such a spouse, son, or daughter.

They're supposed to notify you both when you get your conditional green card, and again near the beginning of the window to remove conditions. We got our notice after we'd already filed the I-751.

If you've moved without telling them, you won't get the notice. There may be other reasons why you won't get a notice. If you don't get a notice, it doesn't relieve you of the requirement to remove conditions.

I used that paper, mailer, when I applied for the replacement card with I-90 just because it said it would speed up the process. I was thinking whether to send it or not, but I did in the end. Does not cost anything, and it certainly cannot slow the process down, though I still wonder how it works and why they need it.

If I get any NOAs these days, I will certainly let you know. ;)

I didn't received any notice too (my window opened Jan 21,2009). The Immigration Officer at my port of entry stapled a note on my Visa for a reminder, though. Perhaps immigrants from the Philippines don't get such reminder by mail; if not all, most I guess?

Hi Everyone,

What? Now everyone gets a reminder as to when to file for removal of conditions? Lol..Gee, I feel so left out, as I never got one of those "I-751 reminders" last year from the USCIS either!

Lol...the only "I-751 reminder" that I got was from the immigration officer at the AOS interview, when they verbally told me afterwards that I had to file for such in 2 years later. As well, the immigration lawyer that used before sent me a letter reminder too (lol..they probably wanted my business again, but I didn't need to hire them this time around).

Oh well, at least I remembered and filed the I-751 on time last year, and that's all that matters, right?

Oh by the way, I never did get that AOS "welcome letter" in the mail (which some VJers mentioned about getting) before I got my 2yr green card...Boy do I feel so "unwelcomed" here....lol.....

Ok, let's see that's 2 letters/reminders that the USCIS still owes me.... Oh well, I'll let that those two letters/reminders slide for now, as again, it doesn't really matter if I get them anyways.

But they better send me that 10yr green card soon, that I paid so much and waited so long for!.... ...I'm not letting this one slide at all!

Ant (Still waiting at the VSC, Still waiting for Baby...)
