total newbie needs help about I-129 and EAD

:( Okay, I am a totally new member (today) and need some help. I "consulted" with an attorney who told me that I couldn't file the I-130 then the I-129 for my husband--she said you couldn't do that to get my husband into the country faster. Of course this morning, after having received NOA 1 for the I-130 2 months ago, I found out otherwise. So, am scrambling to get the 129 paperwork completed to send in. My main question is this: can I submit the I-765 work permit form with the 129 or will I have to wait until the I-129 has been approved and my husband has already gotten to the U.S.? He doesn't want to come here and have to not work a few months but I don't really know what else to do and I'm sure as heck not asking that stupid attorney again. Advice?

works on it before it leaves to go to NVC.

08/21/2006 I-130 rec'd by NVC and case number assigned

08/22/2006 choice of agent form mailed express--got number and then printed barcode acc'd to James shortcuts

08/23/2006 US postal service says agent form rec'd at NVC

Sorry that you got bad information from the attorney; unfortunately, alot of them are not familiar with the K-3. The good news is that you haven't lost any time; I don't think that the I-129fs for spouses/K-3 have been moving much in the past couple of month.

While a K-3 visa was designed to reunite families more quickly, it doesn't always work that way now.

I can tell you that no, you may not submit an I-765 for your husband before he is admitted as a K-3. It is a big drawback to the K-3, IMO, that the immigrant will not have work authorization for 90+ days after arriving.

If immediate work permission is important to you, look more closely at the Immigrant Visa (CR/IR) which is what the I-130 will eventually lead to. It may not take as long as you think!
