K-1's go to Embassies straight from USCIS?

Timeline

I was assured that K-1 visas do not go to NVC, but straight to assigned Embassies. This fellow claimed that is the proceedure for the last several years that he has worked there. I hope it isn't smoke being blown in my direction, but has anyone else got this story from USCIS before? It is quite contrary to what I have read on this site, but hell, I don't know....our NOA2 was Dec 22nd and still haven't heard squat from anyone. Anyone else?????RexT

This 'fellow' is incorrect - NVC will forward approved petitions to the proper Embassy/Consulate (once USCIS sends it to them). :thumbs:

NVC is the "gateway" to the Embassy/Consular system. NVC assigns the petition to a particular consulate as well as the consulate case number. It is impossible to get to a particular consulate without going throught the gateway.

There are several VJ members with NOA2's from the same time frame whose petitions are missing and have never gotten to NVC.

NVC is the "gateway" to the Embassy/Consular system. NVC assigns the petition to a particular consulate as well as the consulate case number. It is impossible to get to a particular consulate without going throught the gateway.

There are several VJ members with NOA2's from the same time frame whose petitions are missing and have never gotten to NVC.

My case was " lost" for a few months between USCIS & NVC. What I went thru trying to find it was unreal. In the pursut of that I was told by USCIS that the last thing they do is assign a bar code to the file & place in special box where they collect finished cases. Those cases are sent on a regular basis to NVC.

It is at the "gateway" NVC where the mystery begins. All cases arrive there with bar code to insure they are not lost. USCIS assured me there was no way they could be lost. NVC said the same.

I think the problem is with the " gatekeepers" . They just dont scan the bar codes in until they are ready to add more case load to the agency. This may be a way to manipulate the system to suit thier needs.

When I asked NVC what could be done they said " no problem just write us a letter asking us to find the file & we will ". I did that. Never heard one word from them even though I called ect & they assured me I would.

I tried the Senator bit as well. Complete waste of time. They cant do shxx. In fact they sent the information they got to the wrong address. I got that info about 2 months later & it was wrong anyway.

To find my case I asked the counsulate to help. They did so & informed me the case was not lost but in fact was on its way to them.

In the end a case that NVC never had was finished & sent. It just took 2 months longer than most.

A whole bunch of August-ish 2008 filers/December NOA2 receivers have gotten used to weird information and weird treatment(s).

NVC most certainly exists and tends to keep your case for 7-ish weeks these days. Especially if you fall into the above mentioned category. At the same time, files go missing before they reach the NVC and then magically appear after.. some months.

Either way, whoever you call, you're likely to get incorrect information.

Interview Date: April 8th 2009, 10:30 - APPROVED!

K-1 Visa Received: April 9th 2009

POE: Aug 8th 2009, Minneapolis

Wedding: Aug 28th 2009

Our case spent 52 days being chewed by NVC.

NVC most certainly exists and tends to keep your case for 7-ish weeks these days. Especially if you fall into the above mentioned category. At the same time, files go missing before they reach the NVC and then magically appear after.. some months.

Either way, whoever you call, you're likely to get incorrect information.

And if you ask how long it will take, they will say "6 months" and that isn't correct either.

The approved petition goes from the service center to the NVC in New Hampshire. They forward it to the correct consulate after they do their thing with it which can take from a few hours to a few weeks. There standard letter is that it will be forwarded to the correct embassy "within a week". The consulate receives the PETITION, then you apply for a visa based on that approved petition and turn in your application (DS-156) at the interview. If the consulate approves your application THEY will produce a visa and put it in your fiancees passport.

When you call, have any numbers which you have been assigned handy. The NOA2 number will be the one you refer to. After it gets to NVC the assign a case number specific to the consulate, but at this point you will not have it, so give them your NOA2 case number

You may want to print some timeline information from The USCIS website so you can educate them when they give you false information. Ask specific questions, "When was my case sent to NVC?" "YES, they ARE sent to NVC, when was my case sent? By what manner? Do you have a tracking number?" "Can I speak to a supervisor please?"
