Last year when my husband filed his taxes he tried to include me also. With attaining ITIN and everything, the whole tax thing kind of got screwed and he never got any return back, nothing with the stimulus package either.

This wednesday me and hubby went to H&R Block and filled out out papers and we will be getting the tax return money pretty soon. Anyways, there was an option with H&R Block where the lady said she could send in last year's papers for further review for an extra $30.

What I want to know is, can my husband refile last year's papers with my name on it? Given that I have got my SSN number and everything? Or, will he has to file as married but seperately (I am not sure about that term).

Just want to know how it works.

Coudln't the Block person give you that information? I know the IRS allows your to do adjustments to prior years' tax filings but not sure about this

Was he due refund by including you in his return last year? Your husband might need to follow up about the status of his return.

If you filed last year with ITIN for married joint filing, both you & your husband would not get stimulus. But you & your husband will be able to recover it by filing the tax this year using stimulus recovery rebate credit (I think you will be asked how much you got paid, since you got nothing you will get the whole check). Your husband can always amend the previous year's return & file married separate.

Jan 3 2005 : Petitioner received copy of DS 3032 and I-864 fee bill. Post-marked Dec 23rd.

Jan 11 2005 : Beneficiary received DS 3032 in Indonesia

Jan 31 2005 : Sent DS 3032 to NVC

Feb 8, 2005 : NVC received DS 3032

Feb 21, 2005 : IV fee generated

Feb 25, 2005 : Sent I-864 fee bill

Feb 28, 2005 : I-864 fee bill delivered to St Louis

Mar 3, 2005 : IV fee bill received

Mar 7, 2005 : Sent IV fee bill

Mar 9, 2005 : IV fee bill delivered to St Louis

Mar 28, 2005 : I-864 fee credited against case.

April 6, 2005 : Received I-864 package

April 7, 2005 : Immigrant Visa fee credited against case.

April 11, 2005 : DS 230 is generated

Aug 12, 2005 : I-864 & DS 230 received by NVC

Sep 14, 2005 : RFE on I-864

Nov 3, 2005 : Checklist response received at NVC

Nov 25, 2005 : Case completion

Dec 9, 2005 : Police Cert requested from the Netherlands

Jan 12 2006 : Interview success - Approved !!

Thanks a lot guys. We will be going to the Block tomorrow again. We were in a rush and couldn't ask them about the details, so I just wanted to do my homework before going there again.

ps-- My husband did get a letter from IRS stating the denial of my ITIN. So I never got an ITIN last year.

Why did they deny the ITIN?

I am not really sure why, but do think it has something to do with notarization of my passport copies. Basically my husband filled taxes at the very last moment (guess on 12th of April or around that time) and I am sure he missed a few papers here and there.

Well we didn't go to H&R block yesterday.......was just being lazy, but hopefully one of the days this week.

I've read a few people's posts claiming they got away without having the documents notarized. I'm not leaving that to chance! Get to Block! It's your money, grab it before they decide to spend it.
