Last night we got the notice said our I-485 is denied!! :crying:

The reason of the denial was insufficient evident for our !-864. Long story short, I believe it's because we filed I-864 for the joint sponsor but not my husband. We thought that since he is a student, has no income and tax return, we don't have to filed the I-864. We did sent in a letter with the forms to state that he has no income. I guess that's not the way it goes.

I don't understand this!! If USCIS would like us to filed I-864 for the pettitioner who has no income, can't they let us know instead of jumping to the decision???

We are very upset. The notice said I will have 30 days to leave the country. :crying:

Should we hire a lawyer to do the motion to reopen? Or can we do this by ourselves?

We do not have enough money to file the whole thing again at the moment. Does it mean that I will have to go home and get the AOS started later?

I'm very upset about the idea of leaving my love here. :(

P.S. If you know a good immigration lawyer in Los Angeles, please let us know also. :help:

The USC Spouse always has to complete an I-864 regardless of income.

Are you certain it was denied? or was an RFE issued (if so, what is the exact wording)?

I'm sure it said denied. It didn't ask for anything in the letter. :crying:

upps! Wait, are you sure it said denied..maybe you just need to send the I-864 again, because that is what happened to me..you have to call the USCIS and asked them what the deal is first before jumping to returning back home.. I know someone who got married as students and they had no income, they had the parents as their joint sponsors. Also, make sure you have supporting documents like why your spouse did not file a tax return it is because he is a dependent of his/her parents. Then,. make sure that the petitioner fills out the I-864 and the joint sponsor fills-out the I-864. Don't panick,..send the forms again in correct format.. if not mistaken I think that is what they want,.use stickies to tell what the papers you sent and make sure you always put the case # on the top of supporting documents..they want you to follow instructions carefully..don't hesitate to call the visacenter to clarify this..they can't deny you on the process,.I am sure that only happens on the interview.. they can't deny you guys just because your husband is a student..

send it again and make sure everything is right this time, don't worry it is not denied...

am so sorry to hear of your plight. if the letter says what you said it says then your not telling us everything. usually if your application is deficient USCIS ask you to send them the information or form that they need.

AOS package sent - 1/30/09

AOS package recieve (IL)- 2/2/09

NOA for all applications- 2/9/09

Biometrics Appoint Notice recieved 2/2/09 for 3/9/09 will try walk in 2/25/09

RFE's for co sponser w2 and 1099, birth certificate, i-693, and immunization recieve 2/15/08

am so sorry to hear of your plight. if the letter says what you said it says then your not telling us everything. usually if your application is deficient USCIS ask you to send them the information or form that they need.

No, that's all the letter said. It said, "You failed to submit the Form !-684 for the petitioner listed on Form I-130. As you have submitted a partial response, you have requested a decision based on the record."

That was not anything like the RFEs.

Form I684???? do you mean the medical form or what? there is no form I-684. If you have failed to reply fully to a RFE then a denial is what happens. what did they ask for?

before we can help you with the best information we need to know exactly what happened in your case.

Oh I just thought you mean form I-864 the Affidavit of Support. so did you supply all the information asked for like tax returns with W2's for at least the last tax year and a letter from the sponsors employer and recent paystubs did you send all of those?

On your timeline, you show an RFE dated 2008-11-04. What was that for? Strange that they requested more evidence but didn't ask for the missing I-864 then.

I'm sorry to read that this happened to you. :( As others have said, contact them. It may be able to be fixed easily.

On your timeline, you show an RFE dated 2008-11-04. What was that for? Strange that they requested more evidence but didn't ask for the missing then.

Im not sure if this is relevant to this case, but when I recieved a rfe on my aos it says that if you do not reply within 89 days it will result in denial. Did you return the rfe with the information requested? Did you track it for delivery.

It's very common to get a flat-out denial if one of the core requirements have not been submitted. A person may get lucky with an RFE, but an RFE generally means there wasn't enough evidence to support one of the requirements (not that one of the requirements is missing).

You can plead with an InfoPass appointment, and they might be able to help you out.

If that doesn't do you any good, resubmitting a new I-485 with ALL requirements is probably cheaper, faster, and more painless than getting a lawyer involved.
