Eventually, I will need a waiver, but when to file it?

I want to bring my wife to US and to do so I'm filling the I-130 & I-129F (K-3 visa) but since we have a misrepresentation from another case that we filed last year, I think we will need to file a I-606 waiver for this misrepresentation. Am I right or wrong? If right, can somebody tell me if I can file the waiver now or I will need to wait until USCIS, NVC or DR consulate find it out?

05-12-09 - Received Consulate

05-19-09 - Interview Date: APPROVED!!!!

05-27-09 - POE (JFK, New York)
