Got denied on my interview b'coz of not having my decision yet at the court from my previous marriage

Indeed. It does appear there was misrepresentation -- who on earth would apply for a fiancee visa while on divorce proceedings? The OP should have waited to file until they had the divorce decree in their hands. It is unbelievable. :wow:

I AGREE. WHy was the K-1 even filed BEFORE you are divorced or annulled?? NOW you will have to file again and it is NOW a big waste of your time for not waiting.

12/13/08 NOA2 received in the mail

12/18/08 Called NVC at (603)334-0700 and talked to a nice lady named Rose. Our case was received on the13th and was sent out to sydney...WE WILL SEE!

12/13/08 NVC received letter and said they sent out to Sydney

12/18/08 received letter in the mail from NVC.

12/19/08 another letter from NVC stating it was shipped out

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

2/20/09 packet 3 sent in

2/26/09 pkt 3 received today takes UP to 10 days

04/07/09 interview....APPROVED!!!!

04/20/09 He flew in ..flight was changed he was 3 hours late BUT HE IS HOME

port of entry took 2 mins!! LOL

04/25/09 WE ARE MARRIED!!!!!!!!!!

I can answer everyones concerns! The approval here in the US is easy. They basically just looks at the papers given and may do a background check on the petitioner but they are not really checking the beneficiary, that is why u have an interview at the US embassy of the beneficiary's country. that's when they check everything about the beneficiary. It happened to us also but we did not lie or anything on the immigration form. My husband was not married ever but at the time of the interview, his CENOMAR in the Philippines showed up a marriage record so his VISA was not denied but put on administrative review. after 6 mos w/out hearing anything from the US embassy, i canceled the petition. to make story short, we had to go thru the annulment process even if it was identity theft. it's philippine law to go thru an annulment to get the marriage null and void. the court discovered w/ the priest as witness that it was not my husband that he married but a much older person using my husband's name. when the annulment decree was issued, we got married and so i re-petitioned for spousal visa.

so, u have to refile once ur annulment has been issued.

Your situation was rather different.

I agree.. yours is a matter of identity theft that was proven later on so u have a valid reason for it.. Theirs is a matter of 'Not declaring previous marriage " or even if she did, The thought of declaring that she is legally able to marry his fiance on the Letter of intent during the time they submitted it was a huge mistake in her part. Her marriage is not yet over since the case is still pending and with no decision yet.

Nobody even knows what exactly happened, so I really think it's safe to assume that a lifetime ban is just one of many possible outcomes.

Hope that the girl will come back even if it is just to read the comments before she and her USC bf make any decision to proceed. Although, we here are hoping for additional information.

I would like to remind/tell you that to move forward, please do not expect the Consular Officer/Embassy to advise you on how to move forward or provide you any tips regarding this other than the most general of things (as what the OP stated she was expecting when she got denied at the interview in one of her posts).

OP, please read all the FAQs and Guides and others' posts here and in other threads as well as the USCIS website, and if you still feel that you need professional input, for you to secure yourself a qualified & experienced immigration lawyer (am not saying that a lawyer can turn the situation around, nor am i suggesting that you appeal it). To be honest, I think most input on this thread is honest, straightforward and very simple. Given from the things you have already told us. It is not with intent to bash or whatnots, although Im sure like me most are shocked that you guys did not give due consideration to the most important requirement of all. Based on what we personally have gone thru (in this process) as well as whats obvious on the law/requirement/insert appropriate term here, that IF indeed you leave blank/omit/said that you are divorced/put on letter of intent that you are free to marry, the probable consequence would be pretty harsh if they so decide to enforce it. IF that wasnt the case, perhaps we, like the CO interviewing you, did not see it the same way as you are seeing it and we are waiting for you to share with us the details.

Personally, i think the best bet is to have your other half move to PI with you.

a friend of mine who had same wt ur case waited for d court decicion til she set for an interview bcoz its very clear n d instruction that b4 filing a K1 or b4 interview, both parties are free to get married. If the consul denied you then denial has a big diff from delaying of issuance of visa...but still prayers is d best weapon to touch God's heart. Good Luck

You can't reset the interview date. You will have to submit another I-129F petition to your local USCIS office and pay another $455 fee. Until your annulment/divorce is done, you weren't qualified for the K-1 anyway, which you wouldnt even be a fiancee.

We are hoping to receive the devorse decree this month i was trying reseting my interview for 3x..

and i cant reset it on the date of my interview..so i was hoping and trying to get some instruction to what i can do,

but the sad thing is they denied me :crying:

I just wanna say thank you for the feedback... so if ever i file for another application for petition do i need to gathered again all

my documents b'coz the embassy took all my recent documents..so i have no new to add as evidence..

one more question is... is there any months or time line before you applying for another petition after you got denied? or you can apply the

new petition anytime?

Honey you are incorrect. If the U.S. wants to find info on anybody outside, including IN the Philippines for visa processing THEY can. It's how they hunt for unfriendly and keep our country safe. Why alot of cases may take time because someone may have a common name of a member related/associated with any member of a known terrorist organization or "unfriendly" folks list the U.S. officials keep out of our country. These U.S. officials do a very good job at it and can have access.

Yes, we had to go through the whole annulment because it is the law in the philippines that once u have a record even if it's not true or not, u still have to process it in the court. in our case, it was not a big issues because the priest was our witness and the so called woman was no where to be found which just tells us more that it is a case of identity use. and YES we waited for about 1 yr for the annulment. so if u count the time from the K1 filing to the K3 visa issuance--it's about 3 1/2 yrs.

and yes, the background checks for the beneficiary is done at his/her country. there is no way of the US to check the marriage records of everyone in the world, that is why u have an interview at the beneficiary's country. yes, they can check criminal background check in the US so if the beneficiary has not been in the US, then of course, the result is negative. the approval here at the USCIS is only base on the papers that you hand in so if u hand in stating that u are free to marry then they assume that is correct. we don't even have a central record in the US for marriage or divorce so how do u think the USCIS can check other countries. that is why they have an interview and docs to prove relationship at the benficiary's country.

i am not lucky like the usually people who got there chance to have a visa...

My Problem is i have my previous marriage before and now i am waiting for my decisions to come this month... But the woman in consul whose interviewing me today she's was denying my papers... she never give me a consideration to wait my decision this month...

So i just wanna know what is the best way that i can do once i received my decision..b'coz the embassy didnt give me an instruction to what i do then

if ever i have my decision from the court... if am i going to apply for new application for petition? or am i going to send the copy of my decision to the USCIS or Appealing for my case.... they we're just told me once my previous marriage not terminated they will never give me a visa thats it...and returned my passport, so no clue about any instruction..

My boyfriend and i we both deppresed about this things happen to us..please kindly give us some advise ..ill wait for your kindly feedback and reply

Just incase you decide to refile again take note of this pointers regarding your annulment...

1. Pag lumabas na yung DECISION... Maghintay ka pa ng few wks para sa CERTIFICATE OF FINALITY, then after nun kumuha ka ng certified true photo copies nung mga yun( DECISION and CERTIFICATE of FINALITY) dun sa RTC kung saan ka nag file nang annulment, then Punta ka ng NSO Main, submit mo yung documents sa kanila then mag request ka for another copy of Marriage cert. it'll take 2 wks or more bago nila maiupdate yun sa database nila. but im sure they will give u naman a specific date kung kelan ka babalik. after matapos yung process sa NSO, They will give u a copy of your "Annotated Marriage Certificate" where in it states where and when the decision is rendered, name of the Judge, case no. and declaration that the marriage bet ween you and your ex husband is null and void from the beginning. try as much as possible to furnish this before kayo mag file ulit.

I know how bad it is being away from our loved ones that we tend na madaliin lahat. Take it one day at a time. sabi nga, slowly but surely.. youll get there..

2. Get as much information u need before filing another petition. Research more here in visa journey. If there something that u dont really understand or confuses you. post it in forums like this again. Im sure there are lots of people who is willing to help you guys out.

3. Lastly, Pray and Hope that youll get through with this..

Yes...she is now in Alabama...when her fiance applied for K1 that time, she intentionally not to include her form325A, so, she has no record at USCIS that time...but her laywer assured her that before the petition approved the annulment will be ok, so, before RFE received by her fiance, the result was already finalized in d court. She got approved May of 2007 at NVC, Consulate received d papers a week after, and 1 month before expiration of her NOA2 and thats on July of 2007, she called USEM to set an interview sched dated Sept 2007, a longer duration bcoz she was worried that time that NSO was not yet updated of d result of her annulmet case. The duration from USCIS approval-calling-set for interview date had a little bit longer gap, but shes fine now. Its only a matter of understanding on their instruction...

Cool.. but the only difference is that im sure your friends annulment is done and she was able to provide a annotated copy from NSO during the interview itself, In their case.. she went into interview with no Court decision yet.. and ofcourse, No annulment decree on hand to prove shes legally able to marry him. :(
