Got denied on my interview b'coz of not having my decision yet at the court from my previous marriage

Actually I am learning from this thread, and perhaps people should be frightened when it comes to lying on forms.

Whatever it takes to tell the truth.

Some here think it's critically important to make people feel good no matter what. For me, it's about getting people the right information so, they can have the proper expectations and the best chance of a successful visa journey, where possible. If the information they need, results in joy, relief, happiness, fear or despair results from the circumstances, the fact and their own reaction.

I don't know whether this couple is feeling fear of consequences, angry because they got caught or whatever. What I don't want them doing is going down a path doomed to a second failure based on the false idea that they can appeal the current decision or simply start over. They are going to have to face whatever the consequences are for what they've already done, regardless of their reason for doing it. I know those consequences could be as serious as the beneficiary never coming the USA, but certainly not a fine or jail time for the foreign beneficiary who has never set foot on US soil. Personally, I'd be far more fearful of thirty days in jail than to continue living my current life, much less losing my freedom for years and all my assets. Just who is scaring the bejeezus out of whom?

I don't really care who likes me or my style but when people make it their mission spank me for scaring people by themselves giving false information even they should know better, it makes me damn angry. A naturalized citizen would know enough to know our criminal courts have no authority to convict and punish people who have never set foot in the US for anything but some grand conspiracy, if even that.

This thread is not about me. It's about a beneficiary, a petitioner and their immigration case. They've made a serious mistake. IMO, their chances of a successful visa journey are out the window and they need to face that fact. If somebody has some advice for them beyond taking their medicine and getting on with their lives the best they can, then let them offer it instead of worrying about whether the truth scares people.

Facts are cheap...knowing how to use them is precious...

No this thread is about bashing repeatedly the OP for you. You have repeated over and over the same thing and it seems you are now enjoying it. I and I am sure most here have got it already. They screwed up and may get banned for life. They get it now.

you should have waited for your decree first before you had your interview...if you receive it try to call the embassy if you can submit it to them and continue the case but i dont think that will work coz you are not really free when you filed so thats a hit.

next time be very careful so you wont go through this over and over again...waste of time, money and it kills you both softly from waiting and waiting and worrying. thats it.

we have the same problem i had my interview last nov 26, 2008 {for CR1 visa) and the consul gave me 221 g requesting for the other divorce papers of my husband the prob is my husband misplaced his papers now my petition was on hold i feel so helpless and hopeless been married for two years and the separation so frusrating and depressing the uscis and nvc should determine and evaluate everything before they submit the petition in the embassy just right now i dunno what will happen to my marriage with this kind of ssituation,,

All he has to do is go to the courts and request another one. I left mine with my husband, and I couldn't find my copy. It took only about an hour.

When we started the process, I went back to the courthouse and obtained multiple notarized copies of my divorce papers. Took about 30 minutes.

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

It wasnt a screw up...it was an outright lie on her part. Thats not screwing up...thats lieing and praying the annulment is final before they find out.

No one takes pleasure out of threads like this...its a darn shame that a couple..or just her thought it was ok to lie about a current marriage in hopes of the process taking long enough so when the interview came the current marriage would be final.

Its a lesson learned...not just for this couple...but for all couples who think its ok to try and lie on government forms.

I understand its hard to be away from your SO...we have all done it or are doing it...lieing on the forms...can cause a longer time apart...so its stupid to do it.

for us to stop this nonsense "conversation"...why not ask her if why her timeline has almost one year gap from receiving Packet 4? Granted that she received her NOA2 almost 2 months only from NOA1...but interview from Packet 4 is hard to believe. Thats why I asked her if she wanted to gather only information if what would be possibly happen if in case they will file K1 while annulment case is going on..., she never responded. So, now I have an idea if her fiance already sent the petition.its not the consul who denied her, but it was USCIS for lying about form G325A. Its only an idea:) PEACE OUT :ot2: and GOOD LUCK...

I have refrained from posting since my last post days ago. My God people do you see what this has become. It has nothing to do with the original post any more. It has turned into an EGO fest. Please remember why this site is here it is to help people and yes call them on their BS, but when all the facts point to a concrete conclusion not just a personal interpretation of the contents of the post. Tell me what positive feedback we have given this girl in the last 15 pages of post and then tell me what is the purpose of VJ any way? Right now I am so confused about if we are here to help each other on our journeys or to "tar and feather a possible misrepresentation on a form? I dont blame the OP for not adding to this post if you were in her shoes would you? 3 days and15 pages of post have been wasted with little or no help for the OP. I am just glad when i got here i got the info i needed without all the "hatters" posting. I know someone is gonna say don't sugarcoat this bad action on the OP behavior, but I wasn't a fly on the wall for the real facts and i never assume anything because as the 15 pages has shown us assuming anything makes you a multiple poster. Bet you thought I was gonna say something else. Let's all just get a life and try to be members who remember why we are here.

The consulates have the right to extend petitions at their discretion. They usually give the applicant a form at the end of the interview giving them their reason for not issuing a visa. I would be interested to hear what this said, but I doubt they will come back to tell us.

We are here to assist. The problem is that we are not here to assist in fraud. It sounds like it is to late for this couple, and it's a shame that they chose to take their chances on the annulment. I am hopeful that this will help others before they decide to lie on their petition.
