You wont be renewing her K3, you will need to file for an "adjustment of status". You can find the forms on the uscis website I-485, and guides here on VJ.

There is also a forum for AOS, there are many people there that can help you through the next steps.

The AOS will give her permission to work and the GC.

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive, and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Thanks!

My wife came to USA with K-3 six months before. Her visa expires in one year.

Question:

1- How do I renew k-3 for next year

2- What do I do for green card now?

I would appreciate your help.

Thanks.

Check out the guides at the top for K3 there's a really good flow chart and everything. You will have to apply for AOS (Adjustment of Status/Green Card) before the visa expires.

But you don't need to extend it, you need to apply for AOS. K3 is not indefinite, you are required to apply for adjustment of status. The only reason you *may* need to extend the K3, is if you file for AOS too late and the K3 expires. As she's only had the K3 6 months, you have ample time to complete AOS before it expires.

Yes, you can renew K-3 visa by using form I-539, i.e., application to extend or change non-immigration status, at least 45-days prior to the expiration of visa.

the 539 form instructions:

Use this form to obtain an extension of K-3/4 status while your permanent residence case is being processed. You may also submit a Form I-765, Application for Employment Authorization, at the same time as this form to request renewal of your employment authorization. You may travel outside of the United States and be readmitted as a K-3/4, if you have a valid passport and K-3/4 visa

so, yes..if you have already filed for AOS you may use this ...thats how i read it, someone correct me if im wrong please.

Correct, if your AOS application is running overtime for whatever reason, you can apply to extend your K3 status. But if you have not yet applied for AOS, filing for an extension is not going to help you.

Filing for extension of status even when you have applied for AOS is a waste of money anyhow, as the AOS will be completed before you would need the extension, if you apply for AOS within a timely manner as one should. If she's only been here 6 months, as I previously said, if you get the AOS stuff in NOW, then she should have no problem and adjustment should be completed with plenty of time left on the K3.

Read the Guides for everything you'll need for AOS.
