I130 (K3) Spouse Visa Question

Timeline

Hi there.

I am asking a quick question for a friend who is currently in the process of applying for a visa for her husband(through the I130). Both of which are living and working in the UK. The question relates to the Affidavit of Support for this, as the USC is working in the UK her income wont be counted towards the affidavit of support. Is it possible for her to get a relative in the US to file the affidavit of support for her husband?

if this is ok to be done do both need to fill the affidavit of support or just let the relative in the US fill it in?

The petitioner always has to fill one out, even if it's not enough. A friend or relative can fill out another. They will have to submit the form, proofs of income like tax transcripts, letter from employer, etc. Also the co-sponsor must provide a photocopy showing their US citizenship or LPR standing. That could be a US birth certificate or id pages from passport. Or if LPR, then the green card.
