Married while on I-94visa

I came here with a B2 visa, i was working in Canada and my Bf which is my husband right was back and fort to visting me, i had a 2 weeks vacation from my job last July 2008 and i came to visit my fiancee and went back to Canada after 2 weeks....last August 2008 i got a chance to visit my Bf again and suppose to go back to work after 1 weeks but my bf doesnt want me to go back because we cant stand to be away each other again....so we decided to live together and get married end of October 2008 my 1-94 was due Dec. 28, but my visa will last until 2010. We are not adjusting my status yet for we are preparing all the papers needed to immigration....and i also want to make sure the correct procedure of filing AOS for my case...is anyone can help me..... :star:

Thanks for that....i want to ask more can i file an AOS..im confused for i came with a Tourist Visa....

Thanks for that....i want to ask more can i file an AOS..im confused for i came with a Tourist Visa....

Whether you can file for AOS from a tourist visa depends on the reason you had to come to the USA. If you can for a visit and fully intended to return to your home country and you have evidence to show you intended to return then you can file for AOS. If on the other hand you came on a tourist visa and planned to stay in the USA and after your marriage file for AOS then NO you can not file for AOS and you should make sure you leave the USA before your I-94 expires, and file for either a CR1/K3
