After a thorough review of the facts of this case, the petition has been returned to the U.S. Citizenship and Immigration Service (USCIS) where the petition was filed for review and possible revocation. It can take several months for the petition to be received by USCIS. We will inform the beneficiary and return all personal items submitted in support of the application to the beneficiary at the appropriate time. This case is now closed in our office.

This is what the email said that I received this morning. I am at wits end. What can I do now if anything to get my fiance's visa approved? What will the USCIS look at? Will they call me in for a interview? What can i do to help my case. I was planning to go back to vietnam in May will this help? Please any help is greatly appreciated.

Not sure going back there in may will help to ur case or not.

While u r there , why not get married and file the Cr-1.

Most of the time Cr has better chance than k-1

02/05/00 - Relationship started

09/08/06 - Engaged & Pregnant!

03/13/08 - I filed for Citizenship

07/22/08 - Became US Citizen

08/02/08 - I-129F sent

08/13/08 - Case received by VSC

08/16/08 - NOA1

08/18/08 - Touched

12/18/08 - Touched again exactly 4 mos. after 1st touch!

12/18/08 - Noa2 @ 3PM-Gracias Dios Mio!

12/24/08 - NVC sent pckg. 3 to Embassy

01/02/09 - Pckg 3 rcvd. by Embassy

01/09/09 - Pckg 3 from Embassy received by beneficiary

02/09/09 - Medical exam

02/16/09 - Sent back checklist and docs required by embassy.

03/13/09 - We will fly to see Daddy Gary

03/16/09 - 1 PM Interview (Pray God he gets visa)

03/16/09 - 5PM INTERVIEW PASSED WOOHOO. Thank God.

03/25/09 - Visa on hand! he went to DHL office after phone call received.

04/18/09 - My Cuchi came, (NYC)a wonderful unbelievable moment!:)

04/20/09 - We applied for marriage licence. (Township Municipal Bldg Health Dept.)

04/23/09 - Licence on hand

04/29/09 - Applied for Social Security (He was in system!)

04/30/09 - Wedding day!!! Yeeebaa

05/07/09 - SS card in mail. "valid for work only with DHS authorization"

05/13/09 - Sent AOS paperwork.

06/16/09 - Biometrics Apptmt.

06/25/09 - EAD Card in mail!

06/26/09 - Letter saying case transfered to Cali.

08/08/09 - Residence Card in Mail! Yuuupiiiiiii.

THE END FOR 2 MORE YEARS.

You need to stop the petition from being returned if you can... You may wish to consult an immigration attorney with specific knowledge of HCMC

The USCIS will sit on the file and do nothing...

Yes study your options and file K-3 or CR1 asap!.

Not the best advice... if the OP does not resolve the reasons for the first refusal, then any other visa type will potentially have the same result...

HCMC refuses spousal visas as well!

Anyone know a good attorney that could help. I dont have lots of money to waste but im willing to spend money on a good lawyer. I know there is mention of a lawyer in Ho Chi Minh City so I use him or get a lawyer here in America?

She has not been told anything yet. In the first post I copied and pasted my email I received from them. She has not got her letter in the mail yet. All i can say is im so heart broken. I would do anything to get my wife here......

Yes, this is a kind of weird thing in Vietnam. Most of us got "married," that is, we had a wedding ceremony, but without paperwork. So we tend to refer to each other as wives and husbands, even though it doesn't have the force of law. They understand this at the HCMC consulate.

Correct we had basically wedding ceremony without paperwork. SO in my heart and mind she is my wife...

As much as the HCMC consulate might understand... you should temper this usage in the immigration world, until such time as it is legally correct.

Contact your congressmen and Marcus Ellis. They may be able to stop it. I contacted mine and they tried to stop it but they were to late. Ellis might be able to go in there and stop it.

If it does get sent back your in for a wait, I would have her do a consult with Marcus Ellis its very reasonable but do it quick because they will go over all the info from the interview when its fresh in her head and he will recomend what is best to do.
