My fiance and I found out today that our packet 3 has been sent. We are trying to get all of the documents together and be prepared. He is adopted and has his adoption papers but not his birth certificate. Do you think that this will be an issue?

I believe I read somewhere that an adopted person from the UK will usually only have their adoption certificate and not their birth certificate. It would make sense, but here in Utah I think they just change the birth certificate to list the adopted parents.

That's correct.

"Adoption Certificate

The certificate must show date and place of adoption, along with the names of the adoptive parents. This certificate must be issued by a public authority and show that a public record exists of the adoption."

Thank you for your help on this. I really appreciate it. It states that if the birth certificate is not available then you have to get a swarn statement showing that it is not available. He was going to order his birth certificate but a lot of times on the birth certificate it will show a totally different name, a name that was given at birth. His adoption papers shows his adoptive parents and all of the other information required. What is the point in providing a document with a different name if that is in fact the case. I am just not sure what we should do. Also, on the embassy website it states that you have to have notarized tax returns but I had read all over VJ that notarizing the tax returns is not required. Is that true. I sent him all of my documents today and I did not have the tax return notarized. I had filed on line and am providing a print out showing it was accepted at the IRS. If someone can let me know, I would greatly appreciate it. Thank you!

Sarah is adopted but she wound up getting a copy of her real birth certificate...and it's been a bit bizarre for her to find out her bio parents' names. Not sure what's going to happen on that front, as I'm leaving it entirely up to her to figure out if she wants to contact her bio dad or not.

David never wanted to know and still doesn't but is willing to do whatever he has to for this process. On her birth certificate does it have her given name or another name? I have had people on VJ tell me that they went to the interview at the London Embassy and the adoption certificate was all that they had to have but the embassy website says differently. What I don't understand is if he has used this document his whole life and it lists his parents name and verifys that he was born in the UK, why does it matter either way? Anyway, sorry to go on a tangent, when you get close to the end and you know...it gets so stressful and I find myself 2nd guessing everything...I just want everything to work out okay...

ellie called to schedule her medical exam today and the lady said all they had available was the day of her interview at 8:50am. her interview is at 10:30am so i was a bit concerned that the timing was tight. so i told ellie to call back and she got another lady on the phone that was able to get her a medical for the day after the interview at 10:30am. weird, but im glad we were able to fix that.

Does anyone know if i can request an interview date after 15th Dec (it seems everyone gets the interviews really quickly in London) or will i be frowned upon wanting it on a certain date?

I am wondering, my fiance and i would like to get married 10th Sept 2010 but this means we would need to get our visa in hand after 15th Dec to ensure we stick with the timelines (enter 6 months, 90 days to get married) if we get it before the 15th Dec then we are going to have to move the wedding forward.

Does anyone know if i can request an interview date after 15th Dec (it seems everyone gets the interviews really quickly in London) or will i be frowned upon wanting it on a certain date?

I am a little confused about what you are trying to ask. The K-1 visa is valid for 6 months, meaning that once you get the K-1 visa, you must enter the United States within 6 months, before the expiry date on the visa. Any time within those 6 months to enter the USA is fine, you can enter the USA the day you get your K-1 visa in hand, if possible. You don't have to wait to enter the USA if you already have your K-1 in hand, getting your visa in hand means you can fly here and enter with the visa. And the 90 days to get married applies after you enter on the K-1. You can get married in the USA anytime within the 90 days period that begins once you enter the USA. 10th Sept 2010 is about a year in the future, why would you have to move the wedding forward now???

But at the minute things are at their fastest so she's afraid she's going to get the K-1 too soon and the visa will be expired before the time to fly over for their wedding which the date she can enter the US on the K-1 and still get married would be Mid June, so she needs her visa to be good by mid June. Which means only getting her visa approved after Mid Dec.

Not many have this issue, because things have been so slow, and just picked up speed so probably when she applied it was said to apply that early, but looking at it now you don't have to plan that far ahead.

Just keep the checklist (packet 3) until mid-end of November and you should be fine getting an interview after Dec 15th. If you're really concerned about it, Just send a cover letter with your checklist explaining you won't be able to attend the interview until after the 15th of Dec. I don't think it'd be frowned on, I've seen others do it with no problem.

Damien & Kelly that is exactly what i was asking, thanks. Basically we got told it would take about 5 months to get our NOA2 and we actually received it after 11 weeks! I will do as advised and get all the info together and then hold onto the package and send off a little later than normal then.

If need be i will do the cover letter also. We would love a September wedding but when push comes to shove i would rather the early wedding and a visa in hand than a later wedding date but no visa because i have held out too long!

With not being able to work until after the wedding we wanted as long as possible to save, so the longer im in England in work, the more money we will have for our life together.

Does anyone know if you are able to apply for a work visa now or do you definately have to wait until after your married?

We're in the same situation, getting our NOA2 so much earlier than we expected. We've set a wedding date of Sept 11, 2010, but we'll probably have a court wedding before then.

He had plans to quit his job in April and spend a month or two going around the UK hiking and saying goodbye to everyone...and he's planned to come to the US in February so we can do an engaged encounter retreat, meet my relatives, etc, so we're hoping to not get the visa until after the middle of February.

That puts us just over 4 months of the NOA2 expiration, so I think I've read on here that you just have to contact the embassy and tell them you would like them to extend it and then send in notarized letters of intent from each party during the interview?

First off I wanted to clarify, when holding onto packet 3, You still have to send in all the paper work they ask for and just hold onto the checklist.

As for the extending the NOA2, I believe it's automatic, but I'm unsure. and Yes, it doesn't say any where you need a notarized up to date letter of intent, but almost every interview I've seen that took place more than 4 months after NOA2 were required to have a notarized up to date letter of intent. Please keep in mind, if your holding the checklist, make sure all your paperwork is collected and dated as close to sending the checklist as possible.

As for working when you get here, I believe JFK airport still gives out the temp EAD stamp which allows work right away, I maybe wrong. but other then that you have to wait til you apply for AOS, and EAD (work permit) which is after the wedding, at the minute it's only taking about 1 month to get the EAD approved, but who knows what it will be like next year. It's so unpredictable!

Nope, no more temp EAD at JFK. Which means none anywhere. :( You have to wait and apply for your EAD with your AOS stuff. At least when you do that, there's no fee beyond the astronomical AOS fee. ;)

It's great to see how much more quickly interview dates are being issued! This thread was full of such frustrated people all summer, it's strange to see people worried about extending because they were approved so much quicker than they had planned. What a great problem to have!!
