Hi Everyone

Before I call the INS I figured I would ask this here

In 2001 I sponcered my step child from the UK , he is now 19 and is not living by our rules as stated when he came to live. We have tried to help him to no avail. He keeps staying at a friends house that we asked him not to stay at and he has been there for 3 months and refuses to come home. His mother is in England. He is not doing what was asked of him under the condition to live in the USA with me and my husband ( his dad )

He has been getting drunk and is just a bag of trouble and I would like to revoke my sponsorship and have him deported back to the UK to his mother. Also last year he worked for 2 months and refused to file a tax return, is that grounds for revocation? It was only 2 months of a PT job that he did not file, but I dont think that it would make a difference, if you dont file I would guess that is against IRS and INS rules no matter how much you made.

I want to call my immigration lawyer and have this done asap, simply, I want him out of here.

how long has he been here? what visa did he come with? If he's adjusted status and has a green card, I'm afraid there's not much that you can do to revoke your sponsorship and/or get him deported. I'm afraid not filing a tax return on 2 months worth of income is not grounds for deportation.

He has been here since 2001 and the card he has is the permanent resident card. It expires in 2010/11. He came here with the 3 month visa thing that you get in the passport and then I sponcered him to stay. I dont know the visa form # off hand. Also once this expires and I dont sign anything petitioning him to stay, can we get rid of him. I know this sounds harsh, but the aggravation I am rerceiving from him is even more harsh on me. Is there anything I can do?

i think he dont need u to sign for the next ten years green card because he is over 18 so he can do he alone...but i think the sponsoring end after 10 years..so if he is not able to take care for himself,wich he has to proof when he file again they wont give him the card again...

Unfortunately it is not that simple as not petitioning him again. He is, based on his years of residency (years since he's had his permanent resident card) is probably eligible to apply for citizenship if he should so chose. In fact, I would recommend that you assist him in doing that because at this point, given what you state, it is the only thing that may end your financial liability.

The term financially liable is misleading because you are not financially liable to support him...instead you can be held financially liable by the US govt. to pay pack to the govt. if the immigrant (your stepson) receives government aid...like food stamps for example.

The Social Security Administration can provide information on how to count qualifying quarters (credits) of work.The obligation also ends if you or the sponsored immigrant dies or if the sponsored immigrant ceases to be a lawful permanent resident and departs the United States. Divorce does not end the sponsorship obligation.

guess what??? he is a big grown up adult. He makes his own decisions. He can legally do everything you can do except buy booze.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

What happened to unconditional love? Most parents have to sit back and allow their teanagers to make their own mistakes, but they are still there for them when the teanager needs them. That is what being a parent is all about.

He is a LPR and there is nothing you can do to get him deported. Thank God.

This response was totally uncalled for... John is correct, the child is now an adult. Despite the pain and agony that the OP might be experiencing, the child is now an ADULT as well as a full fledged legal PERMANENT resident of the USA.

Yes I have been there with a child who is hell bent on destroying everything that his parents have worked hard to provide, A young adult who thinks the world revolves around them, A young adult who appears not to care about their family and chooses to follow their so called friends, A young adult who gets into trouble with the police and ends up in court.

The diffrence is that I the parent never turned my back on him for one second. Yes its hard to stand by and see someone you love make the biggist mistakes of their life, Waiting for them to see the light and return to the person you thought you knew so well.

But to want to get rid of them because they no longer fit in with your life! well what can I say. The world is full of abandoned people after all we live in a throw away world. If it dont fit in then just get rid of it.

Personal attacks on people is a violation of TOS...please temper your words. I suggest you go back and read the original post. It is not this kid's father who wants to deport the child, it is his stepmother, a she, and based upon her statement of the facts there is nothing legally that she can do.

She made an adult decision to sign US government financial sponsorship forms for an intending immigrant. As such, she signaled to the US government that she accepts liability, for a certain amount of time, if the immigrant uses government assistance. She entered into this contract with the US government....not with her stepson. Now that the stepson is exhibiting what Kez/Wolf rightly termed 'usual teenage behavior' she wants to deport him? Not an option afforded under the terms of the original sponsorship agreement and a good thing at that!

According to the timeline stated by the OP, the kid emigrated with his father in 2001, when he was 10 years old, very much a child. One could easily question what kind of parenting this kid received, that at 19 he'd rather stay with friends than at home? We don't know the personal details of this family situation and they're not necessary to answer the OP's question. Deportation of a permanent resident for bad behavior is not allowed. The rest is a private matter to be worked out en familie...period.
