My US spouse has a criminal record. Do you think this will affect my chances of getting a Visa to move to the US to be with him? Anyone had any experience with this?

I-130 Sent : 2008-02-22

I-130 NOA1 : 2008-03-10

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Are you serious, that's the only reason one can get denied as far as criminal record is concerned?

My husband and I are squeaky clean, law abiding citizens with genuine relationship. If for any reason we get denied or seeeeeeriously delayed, but they let crimies come to the States no problem, I will be sooooo pissed.

Oh, hell hath no furry like a woman whose I-130 petition got denied...

Petition approval is not a visa in hand. The immigrant's criminal record is an entirely different story.

Yeah. It's the beneficiary who has to have a 100% clean record.

With regards to the US citizen petitioner, as pushbrk says, it's very specific. The reason why sexual crimes against women and children are singled out is because the law is trying to protect the foreign spouses from abuse. There have supposedly been incidents in the past where US citizens or LPRs got wives and then abused them. So since your husband has no such record, you have nothing to worry about. :)

i have a record from when i was young, over 10 yrs ago i was arrested for possesion of trace elements of cannabis, it was just empty bags and i stupidly took the wrap for a friend.! i only got a causion but i belive it will show when i get my police certificate from the british police.

will this have a major impact on my application and will i get the chance to explain the situation at my interview? i've never used drugs i was just stupid.!

Are you the beneficiary? In that case, it will have an impact.

i am.. what sort of impact would this have? even though i have never used drugs and would be more than happy to have blood/ hair folical tests to back this up would this get my application denied?

If you had a conviction, of course it matters. Will you be denied? I don't know for sure. But you will have to provide criminal record checks of ALL places where you have lived for more than six months since you were 16. If your conviction falls within crimes of moral turpitude, you will face problems and a possible denial.
