Hi all,

My husband (USC) current salary exceeds the poverty mark so he will not use any assets; we live alone, and have no dependents.....can someone please tell me which affidavit of support best suits our situation. Which is the correct form to use, I-864 or the I-864a?

My other question is regarding tax returns. From what I’ve gathered on this site – submitting just one year (most recent) tax return is allowed. My hubby started his current Job during the middle portion of last year. He has not yet filed taxes for 2008, therefore we will submit 2007 tax documents along with 6 current paystubs and a job letter from his current place of employment.

For the 2006 and 2005 tax unfortunately, he did not meet the poverty requirements. With that being said, can he leave the spaces blank for the last two tax year which would be 2006 and 2005?....or does he have to fill in the amount and provide documents to back it up like he would for the 2007 tax year?

If you are the only immigrant your husband will sponsor and he does not need to use his asset or joint sponsor, he can use I-864EZ. He can use I-864, instead, but I-864EZ is much simpler and easier and serve the same purpose.

Since 2008 return is not due yet, using 2007 return as most recent tax return should be acceptable (But I personally think using 2008 return would be better, if he could). If he decides to use 2007 return as the most recent return, he should fill out the line 25 (in case of I-864) or line 19 (in case of I-864EZ) with the adjusted gross income used in 2005 and 2006 returns (do not leave the space blank). Even if he fill out those lines, it is optional to submit tax transcript or copy of tax return w/ supporting documents for 2005 and 2006 return (i.e., he can, but he does not need to).

I used I-864 and did the exact same thing. I only gave them copies of the most recent tax return and fill out the other years amounts (under poverty lines). And it was never an issue...

I heard that they can't request from you your 2008 tax return as you have until April 15th to file.

In this tedious process, we tend to forget that this is all worth it.

I love my hubby beyond anything in this world.
