K1 Approved - Now on to sorting out my work situation!

Hi all!

My fiancee has posted on here before and she has said to me that this is a very useful place to find out information so I am hoping that you guys can help me out also!!

We have recently had our K1 approved and I plan to move from London to Dallas, Texas on or around 26 Feb 2009 and our wedding is planned for 24 May 2009, so just under 90 days after my arrival. I have already stopped working in the UK and I am actively seeking employment in the Dallas area. I have a degree with excellent experience so hope to get snapped up pretty soon!

My question is as follows, would it be best for me to apply for the temporary work visa on my arrival so that I can work right away or would doing this only delay my permanent work visa application (Which I can only apply for after we are married and takes 30 days to receive right?). I don't really want to be out of work for 60 days after my arrival, researching the net leads me to believe that I would definitely not be able to work for at least 30 days whilst I wait for the permanent visa to come through, but I hope to be able to work for the 28 days before the planned wedding date.

If the temporary work visa is feasible I would look for a temporary position for the 28 days or cross my fingers, toes and eyes in the hope of finding an employer that would employ me for the 28 days and then allow me to take absence for the 30 days needed and then return with the work visa in hand!

I hope this all makes sense and I look forward to reading all of your replies, help and opinions :thumbs:

If you submit the I-765 immediately after your arrival (based on classification A6 for a K-1), the authorization is only for 90 days from the day you stepped foot into the USA (timed to expire with your I-94). There is virtually no chance for the approval to come through in time and even if it does it will have very little authorization time left on it before it expires (minimum processing time is about 60 days with many going much longer). It will cost $340 to do this with little or no benefit.

My friend just immigrated from Canada on Oct 4 to Arizona. She filed all necessary papers the following week and just yesterday received her work visa. So it's about 3-4 months for waiting in that state, not sure about Texas, even if there would be a difference in timing.

I think this thread may be useful to read - there have been recent changes which from what I gather means we cannot work prior to receiving our EAD.

You can ask but most POE's refuse to do it... I have not heard if DFW is agreeable or not... JFK is predominantly the only one that has been known to do it on a regular basis... In addition, there are new document standards proposed to go into effect shortly that effectivel "kill" the holders of the 90 day stamp to be able to fill out the I-9 form that is required for all employment

I doubt there is a need to drive to Vegas unless an Elvis wedding is your dream... I am sure a civil ceremony in Texas can be accomplished in short order... In MN it was a 3 day wait from application to marriage license and then three days after the marriage for the "certificate"....

Yup...we are going to do the same. I'll be looking to get married within a week of my arrival (not vegas...just a court house in Florida) and sending those papers off asap.

I cant bear the idea of being off work for to long. I'll go crazy, and my poor husband will bear the brunt of it.

Poor man, has 3-4 months of a pure nutty lady waiting for him at home.....at least there is sunbathing to do until that EAD arrives.

09/23/2009 - I-485 Transferred to CSC

10/02/2009 - EAD Approved (card production) & AP approved!

10/11/2009 - EAD Card received

10/20/2009 - AOS approved, GC card production ordered! (53 days in total)

10/26/2009 - Green Card received - nearly 11 months to the day of our K1 NOA 1!

11/25/2009 - Started my new job!

02/26/2010 - Passed my driving test :-p

07/20/2011 - Eligible to remove conditions

2012 - Going for citizenship

09/20/2011 - Removal of conditions submitted to VSC....here we go...again!

It's been a quick and relatively painless journey thanks to tireless research, dumb luck and this community :)

DONE with USCIS for a while :)

Another benefit to doing the legal marriage soon after arrival is that all the bank accounts / lease /mortgage, etc. paperwork will be in your married name (if you are taking his) so no extra work to do the name changes.

Another benefit to doing the legal marriage soon after arrival is that all the bank accounts / lease /mortgage, etc. paperwork will be in your married name (if you are taking his) so no extra work to do the name changes.

Sorry but all that changed 4 days ago. K-1 visa holders can no longer get the employment authorization at point of entry, and if they do it is not valid. The wording of the I-9 document which employers have to complete for all employees was changed (clarified they say) so that you must have either a green card, an EAD or a specific visa to work for a specific employer in order for the authorization stamp to be valid. It was effective February 2.

As has been pointed out, applying for the EAD separately from the I-485 is expensive and gives little result. In fact, in our case, we applied for both at the same time and got the green card first! Your best bet is to move up your wedding and get the AOS filed as soon as possible.
