I enter states on K3 visa from Philippines, I am ready to leave Manila when I got the information that I have my Immigrant visa interview set for February 18, 2009. We process both almost the same times, paid the fees and I was interviewed and granted a K3. So I entered states with my K3. Anybody can tell me what happen next? And we fax the embassy and we cancel my schedule interview there. We talk to embassy visa unit and they tell me, I can have options to use both visa. But now I'm here in the states, could I just apply for adjustments? Please anyone tell me.

MUCH better and almost as cheap to go back and take your CR-1 interview.

To start CRs are immigrant visas and receive their GC and SS card in the mail shortly after arriving in the US.

No need to go thru the $1010 cost, stress and hassle of doing the AOS.

No need another interview or do biometrics.

Not having a SS card can prevent one doing a lot of things such as get drivers license, joint bank accounts etc.

K3s are nonimmigrant visas and have to go thru AOS. It can take a LONG time to get GC. Can be denied and deported also. Rare but the chance is still there.

If the relationship or petitioner goes “belly up” before the beneficiary has GC in hand they stand an excellent chance of being deported.

At this time if done properly it only takes about a month longer to do the CR-1 or IR-1.

The CR-1 recipient can almost immediately work, get drivers license, joint bank accounts, and anything else where a GC and SS card are required .

PLus can return home without waiting for AP or GC in case of emergency!

K3 visas have to wait at about 3 months for EAD so they can get a SSN.

Petitoner has to qualify financially at the interview and then a few months later at the AOS. Some petitioners have been getting laid off due to the economy causing more AOS problems.

CR/IR only does so once at NVC

WE had LOTS of problems and additional cost adjusting status for the K3.

hey thanks a lot, but I think it's more expensive to get back to Philippines and have my interview, plus the expenses I have to pay for board and lodging in Manila, since I don't have my residence near the embassy, So I might just get the AOS that you said. That's the adjustment right? and t says in site that we can file the I-765 and maybe i'll be granted permanent residence as me and my husband almost reach 2 years. But thanks again

Adjusting status will cost you a minimum of $1010. Actually cost us over $3,000 as USCIS screwed up with the AOS. Plus my wife wasn't able to work for about 4 months more than she would have going with the CR-1. She makes about $3,200 a month! 3x4,000=12,000+!

As I said there are no guarentees you'll get the AOS GC in a short time. Some peeps are still waiting after more than a year.

If you do the CR-1 you will get your GC and the SS card within about a month of arriving back in the US.

LOTS of things you CAN'T do without a SS card.

The choice is yours. My kids would have liked the immigrant visa, but the I-130 petition never arrived at the NVC. She came here on her K-3 and it is a hassle with the ongoing paperwork and fees, but do-able. One thing another poster didn't mention is that there is some rare chance the CR-1 might not be approved, and then you would be stuck, not able to return to the US until any problems are worked out. Then the consulate can also put a case into administrative review, sometimes I think just to reach their quota, or because one piece of paperwork isn't quite right. You can look at our time-line. In our state she couldn't get a driver's license or rectify the social security situation until receiving the EAD, which came this week. The AOS is a pain, but lot's of people go through it. She is not applying until closer to their second anniversary. Removal of conditions sounds much worse than AOS.

If she was denied the CR-1 she'd still have the K3 to return to the uS with.

If she was denied the CR-1 she'd still have the K3 to return to the uS with.

I remember seeing a case on here where a previously K-3 was revoked during the interview when the CR-1 visa application went into AR at the consulate. I don't remember the country. I just would not think it is worth the risk once you are here to go back and have something go wrong. At least here they are together to work it out if something doesn't go right.

There is always the chance of deportation unless one is a US citizen, and I've even heard of a couple of cases where they tried to mistakenly deport citizens!

We've thought about this issue. We've wondered for some months what we would do if the I-130 finally showed up at the NVC. There are pros and cons.

Whatever you do, I wish you well on your journey.

Yes, you may simply adjust status. You've waisted the $470 you paid during the NVC stage but unless you want to travel back home, you may simply pay the $1010 and adjust status.

I have another question about this situation.

What happens to the CR1/IR1 case that has been completed at NVC and you are already here with the K3 visa? Do you have to ask the NVC to keep your case here and not forwarded to the embassy? Is your approved I-130 still valid so that you can adjust status?

I am confused how would you be able to adjust status...

Of course the approved I-130 is still valid. When you file AOS, they'll figure out where your I-130 is but the key issue is they have the record it was approved.
