Hi,

We are planning to abandon AOS. And I am on K-3 visa and we are going through divorce. I-94 expires on March 2010. I'd like to know if I have to leave the country right after we abandon AOS. I have had 2 different information from 2 different lawyers. One says that I can remain in US till I-94 expires which is March/2010 and the other says if AOS is abandoned you have to leave the country.

19/11/2007 Got the NOA2 in mail.

Thirty days after the divorce is final, you must leave. If you don't show up for your AOS interview, you should already be gone.

or, until the expiration on the I-94, whichever comes first.

If your I-94 expires before your divorce is finalized, you may be able to get an extension of stay, if you are legally required to be here to finalize.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card
