My spouse talked to a fellow in immigration. We were trying to apply for my green card. The forms he said to fill out were I-765, I-485, I-131, G325A, I-129F, I-864, and I-693. Am I applying for a K-3 or Cr1 with these applications? Or is this a different application and does it take longer? Can I travel from Canada to the US while the application process is ongoing?

If I married my spouse in Idaho and then came back to Canada, where does the paper work go? Do I file it in Canada or the US?

Who's the US citizen and where does he/she live?

It would help if you could tell more about your situation. Like where you got married, do you live together now, is the US citizen spouse an expat or US-based... then the folks here would be able to suggest what visa is appropriate for you.

Do both US Citizen and spouse live in the USA? Visas are used to enter countries. Chances are, if you're already here, you don't need a visa unless you leave.

I got married to my husband who is an American citizen when I was in Idaho visiting him at Christmas. We were married on December 26, 2008 after which I left to come back to Canada. I am looking to relocate to Idaho to be with him. I have been doing a lot of research and I am not sure which way to go. I talked to guy at immigration, but he seemed quite defensive so it was hard to ask him any questions. Is it better to get a visa or apply for green card or is it the same?

Currently, my husband does not make enough money to support his two children and my three children and myself. I make $36,000 a year in my job in Canada, but it will end when I move to the US so I can't use it as income on the I-864. My husband currently only makes about $25,000 a year so that is far short of the $40,000 we need to qualify at 125% above the poverty line for people. Above my $36,000, I make $6,500 in child support a year that will continue when I move. So our combined income is $31,500 and I do have a car that is paid for and worth about $7,000. I have only recently entered the work force from school and so I have no other savings or assets. My current husband has an extra car worth about $5,000 , but otherwise no assets or savings either.

I need to be able to move to the US and have free access to cross the border because of my ex-husband and mine access agreement with the children. What is the best way to get down to the states? Is it possible to do this without a sponsor? We have no one to ask to become a sponsor. I am beginning to think we might have to wait until we save the $26,000 in cash and assets before I can move down. Can I start other paper work and submit the I-864 when we have enough money, does it work that way where I get approval, but it is based on me showing that we have sufficient money or is it better to wait until we have saved the money?

Then forget that list in your first post. You cannot re-enter after marriage and adjust status. That's visa fraud. Look at the Guide here for the CR1 visa path. You definitely don't want a K3 visa and K4 for three kids. The cost is thousands more and you can't work for at least three months after arrival. Of course, you can visit during the visa process.

The second huge problem you have is sponsorship. A family of 7 requires an income of $41,588. You need three dollars in liquid assets to replace each dollar of income shortfall. A joint sponsor will work but they need to have enough income for their own household size plus four. Once you're here and working, you'll survive ok but that's another reason you want the CR1 visa, not the K3. Kids get the CR2 visa.

Your front end filing costs for four I-130 petitions is going to be $1420. ($355X4)

Does immigration always ask for your finanacial information when you want a visa? This will be the first year my husband will file taxes in the last 3 years since he had no income in the two years previous. Do you think the government will accept a letter saying that he is currently in stable employment?

Your own (husband and wife) assets can be used to make-up a shortfall provided they can be reasonably liquidated within one year. For instance, equity in a primary residence doesn't work.

I am a little confused now. How does it work if you have more than one joint sponsor because I thought you were allowed more than one.

Well, your only problem is your husband's income which is not sufficient enough to sponsor you and your children... but this is not the time to worry about that now... go ahead and apply for a CR1 visa (or IR1 visa if you were married to you husband for more than 2 years) [Start with this guideline, it's gonna show you how you can do the paper work and where to file it]

You can also choose to go for the K3 (for you) and K4 (for your children) visas if you want to, and that gives you the option to divert to CR1 as soon as your petitions are approved at the Service center or proceed with K3 and K4.

it's gonna take them sometime at the service center to approve your petitions and while the process is going try to look for someone who can sponsor you and your children. [Pushbrk has told you who can qualify as a joint-sponsor for your family.]

Already answered. The joint sponsor needs to qualify for their household plus your four. No, they cannot just make up the shortfall. Your own (husband and wife) assets can be used to make-up a shortfall provided they can be reasonably liquidated within one year. For instance, equity in a primary residence doesn't work.

Since there are 4 immigrants it's possible to have as many as four joint sponsors. One for each immigrant. I've never actually seen anybody have separate joint sponsors for part of a family but I suppose it's technically possible. In that case the sponsor would need to qualify for their household size plus the number of immigrants they are sponsoring.
