Is the CR1 still a option?

Hi everybody,

I have a question that i tried to get an answer from my lawyer, but it didn't work :angry:

I'm waiting for the I129 and I130 petitions to be approved ( almost 7 months now). I have two kids . But my lawyer said at the time, not to file an independent I130 for my girls now. She said the best moment to do that as i soon as i arrive in US. Their names are is both petitions.So they are K4.

I've been reading here a lot about give up the K3 and follow the CR1. We would save time and money. As they don't have an independent petition, is the CR1 still a option??? Or now my only choice is to wait to get there?

Besides that, is there anybody here filling for you and stepchildren? Does it take longer time to be approved?

I'm kind of lost, so i'd appreciate any help :star:

CR1 is an option but one that leaves the kids behind. CR2 requires the kids each have their own approved I-130. Seven months into the process is not going to speed things up but since they must be filed eventually, it won't hurt to do it now.

Facts are cheap...knowing how to use them is precious...

without individual I-130's for the kids, CR1/2 is not an option for you.... at the moment K-3/4 is all you have. I doubt the I-130's if filed now have a prayer to catch up. You will need I-130's eventually for the kids but you can submit them with the I-485 later after they arrive.

Because your lawyer was thinking K3/4 and hoping for another big fee to do the two I-130's and three AOS packages.

Do we have to mention that we are filled the K3/K4? No, because no one has yet applied for any visa yet... only a petition for mom

No, step-children doesn't slow teh K3/4 process.

You can still do the CR-1 option, but it will cost alot of money. Each child has to have their own separate petition.. think about the cost of the I-130, then the costs when you fill out paperwork for NVC.

My stepkids got approved in 3 months. My husband's petition took almost 10 months. You can still do it and might get approved soon. The immigration officer told me that children, especially young ones, get approved faster because there are less security checks to do.
