Hey All, I am trying to finish up my AOS package (so it will be already to send in) and I have a question.

I just graduated from college last year, so my income alone over the past three years is not enough for me to be the only sponsor for my husband. I am above the poverty line now, but for the last two years that I was a full-time student, I did not have a full-time job.

So, I asked my dad to contribute his income as well by filling out an I-864A (we have the same address until my husband gets here and we move out and get our own place).

Here is the problem: my dad files his tax returns jointly with my mother. So, does she also need to fill out an I-864A (and therefore also claim her in the household size)? Or can we just declare my dad's income? :unsure:

I think your Dad's signature is enough, but it is a good idea to check with NVC and speak to atleast two different operators and if it is possible, try to speak with a supervisor. In this way, you will avoid any future problems like RFE!! Good luck!!!!

Since your parents are filing jointly, your dad needs to claim your mom in the household size. I think declaring just your dad's income is fine since he's the co-sponsor. But like Rehan said, better check with NVC to avoid future problems.

My AOS package is ready to go, but I'm having a second thought in sending it by itself. Maybe I'll just wait and send the AOS and DS-230 packages together. I've been reading that some people get false RFEs when sending just the AOS package (because they're looking for the DS-230 package to review next). I don't think my heart can handle any more stress especially if it's over a false RFE. I don't know, I'm so confused. :wacko:

Hey Carlish... I am going to send my AOS packet tomorrow morning (obviously without the DS230 package). I have never heard of anyone getting an RFE for not sending them together. We are following directions... so I don't understand why we would be penalized for that. :unsure:

However, I do understand why you are concerned. If you decide not to send them together, I will let you know what happens when I send my AOS by itself tomorrow.

If I decide to send the AOS packet, I will do it tomorrow too. I printed my own cover letter for the AOS packet this morning. Everything is ready to go! I'll decide soon. ;)

BTW, did you mail the hard copy of the DS-3032? Though we emailed it already, I'm planning to send the hard copy too just in case our emailed version doesn't get through. It's been 6 days and the emailed DS-3032 hasn't been accepted by the NVC system yet. :wacko:

I decided not to e-mail the DS3032.

I sent the hard copy earlier today using priority overnight (which means it is guarunteed to get there tomorrow morning by 10am).

I know a lot of people (and VJers) e-mail the DS3032 without any problems... but all of the instructions that I received said to mail it... so I just wanted to be safe.

I have also heard that for some strange reason, it can actually take longer for the NVC to process an e-mailed DS3032 over one that is mailed in. I have no idea why... but that is what I hear. :unsure:

BTW, which federal income tax returns are you submitting? Are you including 2008? There's a separate thread here that someone has gotten RFE for submitting a photocopy of the 1040A form for 2008 (NVC operator told this applicant that they are not accepting photocopy of the 1040A for 2008). Since I have transcripts for 2005 to 2007 plus a photocopy of the 1040A including W2 and 1099, I'm thinking of revising my I-864 to exclude 2008 and only list 2005, 2006, and 2007 in Q25.

I was planning on including 2008. I thought that we had to. I have been hearing the opposite... that people are getting RFE's for not including 2008. So, I was planning on submitting 2008, 2007 and 2006.

Maybe it is because the applicant was submitting a 1040A? I am not sure... I know that my 2008 return is a 1040 and the 2007 and 2006 returns are 1040EZ.

You are mailing before the IRS deadline,so you should send only 2007, 2006, 2005. But again, please call NVC and ask them. OR to be on the safe side you can include all four, so if they don't need 2005, they will disregard it.
