I really should start bookmarking pages on this thread :)

I know million pple have asked and answered how to get around the mistake on I-864 where it asks for household size, you know the one where if you answer every question correctly then you would end up with an extra household member.

It's just my hubster and me in household, so how should I answer it correctly again?

Never mind, I am stupid, I can do I-864EZ cause it's just me and hubster and i am only using my income as evidence of support, so house hold size is already filled out for us :)

don't worry, I'll come back with more questions to keep myself in check :lol:

My IRS issue has been assigned to the IRS Advocacy team and should receive a response on 6/9/2009 with updates. I would like to send the following letter with i864 tomorrow. Thoughts?? please feel free to modify the letter.

In lue of my 2008 US tax transcript I am submitting a copy of my W2, a copy of my tax return, pay stubs and letter of employment from IPRO Tech. The reasons in which I cannot submit the transcripts for the 2008 tax year is delayed by the IRS with receiving an ITIN number for my spouse (Beneficiary Case Number MTL**********). There was a delay in processing as the actual signed W7 is not to be found. Please accept the above documents in lue of the 2008 tax transcripts.

It looks good, but instead of mentioning about the delay of getting an ITIN, why not also mention that you have filed for an extension? Assuming of course, you did.

Also, there's a specific instruction on submitting additional information on a separate sheet of paper. I think you should follow that format. You need to type in the case number on the upper right corner and include what question on the I-864 you're providing additional information.

Also, change from "lue" to "lieu" :wink:

I would leave the explanation of the delay on IRS' part, but I would add tax extension evidence to it.

Also, this is maybe just me from being a little complicated, but if you have the receipt and tracking # from post office when you mailed out the w-7 where it shows IRS address, I would photocopy that as well and send it.

I am planning to do that for my AOS packet.

Yes, a photocopy is fine.

Yes, you have to leave it unchecked. May I ask why are you getting into this hassale of getting an ITNN for your supose. I have seen many people including my cousins who filed as a single becasue their wives were not in the US. They never had any problem with NVC and even at consulate level because if your spouse is not here in the US, for IRS purpose, you are single. I also have three different accountants for last five years and they told me the same thing. Yes, you can get an ITIN and file as married, but it is not required. When your wife comes to the US, the,you can amend your Taxes and change your status when she gets a social security card. Good luck!!
