My husband, who is going to be a USC, is planning to petition my 6 year old daughter in the Philippines.(his step daughter)

My problem is, the I-130 application says that we need to send a copy of my daughter's birth certificate with BOTH parents' name..but, only my name was written there..

What will I do? Do I also need to have a written consent from my ex? We are not married.

Do I need to have a Travel Clearance from DSWD too?

I'm frustrated, I really miss my daughter :crying:

Please help, fellow filipinas ^_^

sounds like he must have adopted her legally, already. adoption rules are funny from country to country.

child trafficking rules in PI make the father's signature mandatory, from what i understand. surely there is some way for you to accomplish, depending on details related to the lack of identity of father. you must give more info about that question before you can get an answer.

You can leave the father's name "N/A" since his name is not included in your child's birth certificate.

According the the DSWD website (Underlined words are mine):

WHAT ARE THE REQUIREMENTS IN SECURING A TRAVEL CLEARANCE?

Duly accomplished application form;

Photocopy of the
birth certificate
or passport of the minor;

A written consent of both parents or
the solo parent
or the legal guardian permitting the child to travel alone or with someone else to a foreign country;

As appropriate,

a photocopy of the marriage certificate of the minors parents or;

a photocopy of the certificate of legal guardianship of the minor or;

a
photocopy of the solo parent identification card from the municipal social welfare and development office
or Tallaq or Fasakh Certification from the Shariah court or any Muslim Barangay or religious leader;

i
n the case of an illegitimate minor, a certificate of no marriage from the local civil registrar;

in the case of a deceased parent, a photocopy of the death certificate;

My USC husband petitioned my son in 2006 and I submitted his birth cert which doesn't have the father's name in it. No one has asked me for additional information regarding the matter, and my son is scheduled for his interview this month.

If you're a single mom and no father's name reflected there, you should be okay. Follow sugbumama's advice.

3.15.2014: Mailed I-130 Packet for Mom and Dad

3.21.2014: Received email notification with case # for both petitions; case forwarded to NBC for processing

3.21.2014: Check cashed

3.22.2014: Hard copy NOA1 received

4.08.2014: Both I-130 approved (notification received via email) - It only took three weeks!!!

4.11.2014: Received NOA2 approval notice in the mail.

5.01.2014: Called NVC to ask for status of paperwork. Advised they received both application on 4.28. Advised to call in 30 business days for an update.

6.02.2014: Email notification received from NVC that shows parents' NVC case number and instructions to pay AOS Fee and fill out DS 261.

6.03.2014: Paid AOS fee ($88 for both petitions)

N400:
4.26.2013: Mailed N400 Packet

5.21.2013: Biometrics

7.18.2013: Testing and Interview

9.25.2013: Oath Ceremony

From my understanding of Philippine law fathers who were not married to the mother of their children and were not listed on the birth certificate have very little if any rights in regards to their children. If this is the case with the OP then I doubt she would need anything from the father of the children.

Whatever the I-130 requires you to include, include it. I don't have my son's paperwork in front of me but for the I-130 it was pretty straightforward. Just follow the instructions on the form, and send it in along with the fee, to the right address.

I think the bulk of the forms required happened after the I-130 was approved. Everything from birth certificate, police clearance, etc. But with your child just 6 yo, it shouldn't be a problem.
